41 STATE OF TEXAS AGREEMENT COUNTY OF CALDWELL KNOW ALL PERSONS BY THESE PRESENTS: This Agreement on implementation of a buildings for land transfer, made and entered into this 10 day of October , 1989, by and between the City of San Marcos, a municipal body of the State of Texas, and the United States of America, acting by and through the u.S. Deprtment of Labor. WITNESSETH: WHEREAS, the City of San Marcos, Texas, (City"), the Federal Aviation Administration ("FAA"), and the U.S. Department of Labor ("DOL"), did on the 8th day of April 1988, enter into an agreement wherein the FAA agreed to provide E u nd i nq to the City for the acquisition of certain DOL land at the Gary Job Corps Center (GJCC), San Marcos,Texas; the City agreed to construct certain improvements on remaining land at the Job Corps Center; and the DOL agreed to transfer title to approximately 42 acres of land at the Gary Job Corps Center to the City; and, ¡mEREAS, in accordance with said agreement the City has engaged the services of Charles Willis and Associates, Architects, to design and prepare plans, specifications and other necessary documents (construction documents entitled "Plans for Functional Replacement of Gary Job Corps Pacilities"- City of San Marcos Proiect 86-589-636) for the construction of the replacement facilities at the Gary Job Corps Center (the Pro j ec t ); and, WHEREAS, it is necessary for the efficient and orderly execution of the Project that the City and the DOL define their resoective responsibilities during the design, bidding, construction and post-construction phases of the Project, NOW THEREFORE, BE IT AGREED AS FOLLOWS: I DESIGN PHASE The Ci ty has at its expense engaged a competent, qualified architect to design replacement facilities for the following bui ldings at the GJCC:
