<br /> 41 <br />STATE OF TEXAS <br /> AGREEMENT <br />COUNTY OF CALDWELL <br />KNOW ALL PERSONS BY THESE PRESENTS: <br /> This Agreement on implementation of a buildings for land <br />transfer, made and entered into this 10 day of October , <br />1989, by and between the City of San Marcos, a municipal body of the <br />State of Texas, and the United States of America, acting by and through <br />the u.S. Deprtment of Labor. <br /> WITNESSETH: <br /> WHEREAS, the City of San Marcos, Texas, (City"), the Federal <br />Aviation Administration ("FAA"), and the U.S. Department of Labor <br />("DOL"), did on the 8th day of April 1988, enter into an <br />agreement wherein the FAA agreed to provide E u nd i nq to the <br />City for the acquisition of certain DOL land at the Gary Job Corps <br />Center (GJCC), San Marcos,Texas; the City agreed to construct certain <br />improvements on remaining land at the Job Corps Center; and the DOL <br />agreed to transfer title to approximately 42 acres of land at the Gary <br />Job Corps Center to the City; and, <br /> ¡mEREAS, in accordance with said agreement the City has engaged <br />the services of Charles Willis and Associates, Architects, to design <br />and prepare plans, specifications and other necessary documents <br />(construction documents entitled "Plans for Functional Replacement of <br />Gary Job Corps Pacilities"- City of San Marcos Proiect 86-589-636) for <br />the construction of the replacement facilities at the Gary Job Corps <br />Center (the Pro j ec t ); and, <br /> WHEREAS, it is necessary for the efficient and orderly execution <br />of the Project that the City and the DOL define their resoective <br />responsibilities during the design, bidding, construction and <br />post-construction phases of the Project, <br /> NOW THEREFORE, BE IT AGREED AS FOLLOWS: <br /> I <br /> DESIGN PHASE <br /> The Ci ty has at its expense engaged a competent, qualified <br />architect to design replacement facilities for the following bui ldings <br />at the GJCC: <br />
