<br />45 <br />"-..9 ORDINANCE 1989-47 <br /> <br /> <br />~ An OPDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING ARTICLE II POLICE DEPARTMENT OF <br />CHAPTER 21 OF THE CODE OF ORDINANCES OF SAID CITY TO <br />ADD DIVISION 6, SPECIAL ASSIGNMENT SERVICES-K-9 <br />HANDLER, AUTHORIZING ASSIGNMENT PAY FOR THE POSITION OF <br />^ POLICE K-9 HANDLER, RENUMBERING CERTAIN SECTIONS OF <br />., CHAPTER 21, PROVIDING SEVERABILITY AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, has <br />determined that the San Marcos Police Department K-9 handler is exposed <br />to a great number of high risk calls due to his assignment and <br />availability status; and, <br /> <br />WHEREAS, said K-9 handler is further required in the course of his <br />duties to expend personal time without other compensation for the care <br />and treatment of his assigned animal and for the benefit of the City <br />and public; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos desires to <br />insure that the K-g handler is fairly compensated for special <br />assignments; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That Article II, Police Department, of Chapter 21 of the <br />Code of Ordinances of said City is hereby amended by the addition of <br />Division 6 to read as follows: <br /> <br />DIVISION 6. SPECIAL ASSIGNMENT SERVICES-K-9 HANDLER <br /> <br />Sec. 21-41. Purposes. <br /> <br />The purposes of this divisioh are: <br /> <br />(1) To aid the police department in providing a valuable aid <br />for use in criminal apprehension, evidence detection, <br />crowd control, drug detection, and promoting favorable <br />public realations. <br /> <br />(2) To provide a uniform rate of pay for performance of <br />serVIces. <br /> <br /> <br />Sec. 21-42. Assignments; number and qualifications of <br />employees; hours of service; and supervision. <br /> <br />(a) Up to three (3) police department employees serving in the <br />rank of police officer, police corporal, or police <br />sergeant, and meeting the qualifications set forth below, and <br />being selected and assigned by the chief of police may perform <br />special assignment services under this division as K-9 handler. <br /> <br />(1) Minimum of one year service with the San Marcos Police <br />Department; <br /> <br />(2) Demonstrated knowledge as determined by the chief of <br />police, according to the San Marcos Police Department <br />policies, procedures, and rules; <br /> <br />(3) Demonstrated technical ability, as determined by the <br />chief of police, in performance of police K-9 handling <br />duties. <br /> <br />(4) Certified and approved by the chief of police as a <br />police K-9 handler. <br /> <br />(b) Special assignment services, K-9 handler duty shifts shall <br />be assigned on an as-needed basis by the chief of police in <br />his sole discretion. <br />
