<br /> -2- <br /> (c) Special assignment services shall be performed in ten hour <br /> shifts during the police officers', police corporal's, and/ or <br /> police sergeant's regular ten hour duty shift with the police <br /> department and such special assignment services personnel <br /> shall at all times while on special assignment services duty <br /> continue to perform their regular police functions and <br /> duties when not actively engaged in the performance of such <br /> special assignment services. <br /> (d) Special assignment K-9 handler while on duty as such shall <br /> remain under the supervision of the officer in charge at <br /> the police department. <br /> Sec. 21-43. Compensation. <br /> The designated police K-9 handler or handlers shall be <br /> compensated ten Dollars ($10.00) per 10 hour shift in addition <br /> to regular pay for performance of special services duly related <br /> to their K-9 assignment during their regular police duty shift. <br /> Such officer or officers shall not be compensated pursuant to <br /> this section for overtime (any time over ten (10) hours) duty <br /> performed during any period of time other than the officers' <br /> regular ten-hour police shift. <br /> Sec. 21-44. Status of employees. <br /> Police department personnel performing special assignment <br /> services under this division are in an on-duty status with full <br /> workers' compensation, health and medical, disability, pension <br /> and retirement coverages and benefits and all other related <br /> benefits and coverages. Such personnel shall obey all laws, <br /> rules, regulations, and policies of the city and all other <br /> applicable jurisdictions while performing special assignment <br /> services duty. <br /> Sec. 21-45. Interference with police officer. <br /> It is unlawful for any person to interfere with a police <br /> officer who is performing official duties under this division. <br /> Violation of this section is a Class C misdemeanor punishable <br /> upon conviction by a fine not less than fifty dollars ($50.00) <br /> and not more than two hundred dollars ($200.00) <br /> PART 2. That Article III, Fire Department, of Chapter 21, <br />Sections 21-41 through 21-52 are hereby renumbered in proper sequential <br />order accordingly. <br /> PART 3. If any provision, section, sentence, clause or phrase of <br />this ordinance, or its application to any person or set of <br />circumstances is for any reason held to be unconstitutional, void or <br />invalid, or for any reason unenforceable, the validity of the remaining <br />portions of this ordinance or its application to other persons or sets <br />of circumstances shall not be affected thereby, it being the intent of <br />the City Council of the City of San Marcos in adopting this ordinance <br />that no portion of it or provision or regulation contained in it shall <br />become inoperative or fail by reason of any unconstitutionality or <br />invalidity of any other portion, provision or regulation. <br /> SECTION 4. That this Ordinance shall be in effect ten (10) days <br />from and after its passage, and it shall be published in a newspaper of <br />general circulation in the area as required by the Charter of the City <br />of San Marcos, Texas. <br /> PASSED AND APPROVED on first reading September 11, 1989. <br /> PASSED AND APPROVED on second read i ng September 25, 1989. <br />
