<br /> 55 <br /> STATE OF TEXAS <br /> COUNTY OF HAYS & CALDWELL <br /> SAN MARCOS RIVER STEWARDSHIP PROGRAM AGREEMENT <br /> This San Marcos River Stewardship Program Agreement <br /> ( "Agreement") is made by and between the City of San Marcos <br /> ("City"), and Southwest Texas State University ("University"). <br /> WHEREAS, the City Council of the City of San Marcos, Texas, <br /> has determined that a stewardship and maintenance program for the <br /> San Marcos River would be in the public interest in order to <br /> restore the San Marcos River to a river free from trash, <br /> sedimentation and unnecessary bogs of vegetation and clippings, <br /> and in order to provide a constant environment for aquatic life; <br /> and, <br /> WHEREAS, Southwest Texas State Uni vers i ty has proposed that <br /> the City of San Marcos enter into an agreement with it for the <br /> stewardship and maintenance of the San Marcos River; <br /> NOW, THEREFORE, the City and the University agree as follows: <br /> 1. The University will perform stewardship and maintenance <br /> services ("the stewardship program") for the San Marcos River <br /> under the direction of the City of San Marcos Parks and Recreation <br /> Department. <br /> 2. The parties agree that the stewardship program will focus <br /> on the portion of the San Marcos River between its headwaters and <br /> the 1-35 Bridge. <br /> 3. The stewardship program will be implemented in two <br /> phases as follows: <br /> (a) PHASE I: September 1989-May 1990. <br />
