<br /> -2- <br /> SECTION 5. Periodic Payments: Funds to be paici by the City as <br /> <br /> provided in Section 3 above shall be released to PHS in approximately <br /> equal quarterly payments beginning wi th October 1, 1989, and <br /> continuing with the quarters beqinning on January 1, 1990, April 1 , <br /> 1990 and July 1, 1990. <br /> SECTION 6. Monitorinc¡ Of Performance: PHS ag rees to allow the <br /> City, either directly or through its Human Services Advisory Board, to <br /> inspect, at City's request, and with advance notice to PHS, all <br /> pertinent records, files, information or other written material <br /> maintained by PHS or its subcontractors and re la ted to the subject <br /> matter of this contract. Any failure by PHS to provide such r-ecords <br /> as reques ted by City in a timely manner may be deemed by the City to <br /> be a br-each of this contr-act by PHS. Notwithstanding the fore<}oing <br /> r-equirements of this Section, the City acknowledges the need for <br /> conficientiality of client records and a'lrees that information <br /> which personally identifies individual clients will not be sought or <br /> r-equ ired. <br /> SECTION 7. Sub-contracts. No part of this contract may be <br /> subcontracted to any other person, corporation, entity, organization or <br /> association without the prior written consent of the City to such <br /> sub-contractor- and to the ter-ms and conditions of any such <br /> sub-contract. <br /> SECTION 8. Political Activity. No portion of the funds r-eceived <br /> by PHS under this contract shall be used, directly or indirectly, for <br /> any political activity including any activity to further the election <br /> or- defeat of any candidate for public office or any activity undertaken <br /> to influence the passag e, defeat or final content of legislation. <br />
