<br /> -6- <br /> IV. <br /> Consideration due and payable by LESSEE to LESSOR pursuant to <br /> Paragraph III(A)(l) and III(B)(l) above shall be paid quarterly, in <br /> advance, no later than the tenth (lOth) day after the closing of each <br /> quarterly payment period. The first payment shall be due and payable <br /> on or before the tenth (10th) day after the execution of this Agreement <br /> with subsequent payments being due and payable on or before the tenth <br /> (lOth) day after the expiration of three (3) months following the date <br /> of execution of this Agreement. <br /> Payment by LESSEE of consideration to LESSOR pursuant to <br /> in Paragraph III (A)(2) and III(A)(3) above shal1 be made quarterly and <br /> is due and payable no later than the tenth (lOth) day after the <br /> closing of each quarterly payment period. The first payment shall be <br /> due and payable on or before the tenth (lOth) day after the <br /> expiration of three (3) months following the date of execution of <br /> this Agreement. A copy of all invoices, delivery and sales <br /> receipts, bills, and other wri tten e.vidence to subtantiate the amount <br /> of consideration due LESSOR shal1 accompany each payment by <br /> LESSEE. Payment of consideration shall be made to the City of San <br /> Marcos, Texas, at 630 E. Hopkins, San Marcos, Texas, 78666. All <br /> financial records of LESSEE pertaining to the amount' of <br /> consideration due pursuant to this Agreement shal1 be subject to audit <br /> and inspection by LESSOR during all regular business hours of <br /> LESSEE. <br /> v. <br /> A. Maintenance Responsibilities--FBO Operation. <br /> LESSEE shall assume responsibility for the maintenance, repairs, <br /> upkeep and janitorial maintenance of the demised premises described in <br /> Paragraph I(A) above, excluding the common areas of the aviation <br /> terminal building and the grounds surrounding said terminal building, <br /> and LESSEE shall at all times keep the same in a sanitary, safe <br /> and sightly condition and in a state of good repair. LESSEE shall be <br /> responsible for the payment of all utility charges incurred <br /> other than charges for electricity and water usage. <br />
