<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF
<br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984
<br />(VOL. 66) BY ZONING PREVIOUSLY UNZONED PROPERTY TO A
<br />ZONING DESIGNATION OF "R-1" (SINGLE-FAMILY DWELLING
<br />DISTRICT) (LOW DENSITY) BEING TRACT 1: 28.45 ACRES OF
<br />LAND OUT OF THE R. H. WILLIAMS SURVEY-ABSTRACT NO. 470
<br />AND THE T.J. CHAMBERS SURVEY-ABSTRACT NO.2, HAYS COUNTY,
<br />TEXAS, BEING A 27.38 ACRE PORTION OF A CALLED 43.11 ACRE
<br />TRACT AND A 1.07 ACRE PORTION OF A CALLED 1.81 ACRE TRACT

<br />SURVEY-ABSTRACT NO.2 IN HAYS COUNTY, TEXAS, SAID 1.44
<br />ACRE TRACT BEING A PORTION OF THE REMAINDER OF A 232.1 ACRE
<br />TRACT OF LAND DESCRIBED IN A DEED TO MILTON DANIEL BUIE
<br />PROPERTIES PARTNERSHIP AS RECORDED IN VOLUME 399, PAGE 326
<br />OF THE HAYS COUNTY DEED RECORDS, BEING A TOTAL OF 29.84
<br />ACRES, MORE OR LESS OF LAND AREA LOCATED SOUTHWEST OF
<br />CASTLE FOREST SUBDIVISION; AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on September 5,1989, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to
<br />zone previously unzoned property to a zoning designation of
<br />"R-1" (Single-Family Dwelling District) (Low Density), being TRACT 1:
<br />28.45 acres of land out of the R.H. Williams Survey-Abstract No. 470
<br />and the T.J. Chambers Survey-Abstract No.2, Hays County, Texas, and
<br />TRACT 2: 1.44 acre tract of land situated in the R.H. Williams Survey
<br />Abstract No.2 in Hays County, Texas, being a total of 29.89
<br />acres, more or less, of land area located Southwest of Castle Forest
<br />Subdivision in the City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to the publ ic hearing on that date, the
<br />Commission did, on September 5, 1989, consider the request and voted
<br />to approve it and has recommended that the request be approved by
<br />the City Council; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the II day
<br />of December, 1989, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described tracts of real property
<br />located in San Marcos, Hays County, Texas; which are presently
<br />Unzoned henceforth shall be zoned "R-I" (Single Family Dwelling
<br />District) (Low Density):
