<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF
<br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984
<br />(VOL. 66) BY ZONING PREVIOUSLY UNZONED PROPERTY TO A
<br />ZONING DESIGNATION OF "PD" (PRE-DEVELOPMENT DISTRICT),
<br />BEING 196 ACRES, MORE OR LESS, OF LAND AREA IN HAYS COUNTY,
<br />TEXAS, LOCATED ALONG THE SOUTHEAST SIDE OF THE 700-1100
<br />BLOCKS OF RIVER ROAD; AND DECLARING AN EFFECTIVE DATE.

<br />
<br />WHEREAS, on September 5, 1989, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to
<br />zone previously unzoned property to a zoning designation of "PD"
<br />(Pre-Development District), being 196 acres, more or less, of land
<br />located along the southeast side of the 700-1100 blocks of River Road
<br />in the City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Commission did, on September 5, 1989, consider the request and voted
<br />to approve it and has recommended that the request be approved by
<br />the City Council; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the II day
<br />of December, 1989, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF ,THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />Unzoned henceforth shall be zoned "PD" (Pre-Development District):
<br />
<br />Beginning at a point in the Southwest line of the City Limits as
<br />defined by Ordinance No. 1967-7 at the intersection of the
<br />Northwest line of River Road and the West line of Texas State
<br />Highway No. 80;
<br />
<br />Thence, with the Southwest line of the present City Limits as
<br />defined by Ordinance No. 1964-7, crossing River Road in a
<br />Southeasterly direction to the intersection of the Southeast
<br />line of River Road with the South line of Highway No. 80, same
<br />being the most Westerly Northwest corner of that 1.652 acre
<br />tract of land retained by Bimms Investments as Tract B by deed
<br />recorded in Volume 584, Page 501, Deed Records of Hays County,
<br />Texas;
<br />
<br />Thence, continuing with the Southwest line of said present City
<br />Limits and the South and Southwest lines of said Highway No. 80,
<br />in an Easterly and Southeasterly direction to the East corner of
<br />said 1.652 acre tract, same being a North corner of that 11.158
<br />acre tract of land conveyed to Clayton Enterprises, Inc. by deed
<br />recorded in Volume 584, Page 501, said Deed Records;
<br />
<br />Thence, continuing with said Southwest line of Highway No. 80
<br />and said present City Limits, and with the Northeast line of
<br />said 11.158 acre tract, in a Southeasterly direction, to the
<br />centerline of the Blanco River, for the East corner thereof, and
<br />the North corner of that 57.059 acre tract of land conveyed to
<br />Sylong Lin, et ale by deed recorded in Volume 433, Page 361,
<br />said Deed Records;
<br />
<br />Thence, with the center of the Blanco River, same being the
<br />Southeast line of said 11.158 acre tract, and the Northwest line
<br />of said Lin tract, in a Southwesterly direction to the South
<br />corner of said 11.158 acre tract, same being the East corner of
<br />that tract of land conveyed to Harry T. Bugge, Jr. by deed
<br />recorded in Volume 271, Page 581, said Deed Records;
