<br />RESOLUTION 1988-53R <br /> <br />72 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN <br />AGREEMENT BETWEEN SAID CITY AND HANDLER SMITH AND <br />COLLEEN SMITH SHELTON FOR THE CONSTRUCTION OF A WATER <br />PRODUCTION FACILITY ON 429 ACRES, MORE OR LESS, FOR THE <br />PURPOSE OF INCREASING WELL CAPACITY FOR LOW LEVEL AND <br />HIGH LEVEL SYSTEMS WITHIN SAID CITY, AUTHORIZING THE <br />MAYOR TO EXECUTE SAID AGREEMENT AND DECLARING <br />EFFECTI VE DATE. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />PART 1. That the terms and conditions of an agreement between the <br />City of San Marcos, Texas, and Handler Smith and Colleen Smith Shelton <br />for the construction of a water production facility on 429 acres, more <br />or less, for the purpose of increasing well capacity for low level and <br />high level systems within said City, a copy of said Agreement being <br />attached hereto and incorporated herein for all purposes, is hereby in <br />all things approved. <br /> <br />PART 2. <br /> <br />That the Mayor is authorized to <br /> <br />execute <br /> <br />said <br /> <br />Ag reemen t. <br /> <br />PART 3.
