<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, CANVASSING RETURNS AND
<br />DECLARING RESULTS OF THE SPECIAL AND GENERAL
<br />ELECTION HELD ON MAY 7, 1988 FOR THE PURPOSE
<br />OF ELECTING A MAYOR, A CITY COUNCIL MEMBER,
<br />PLACE FIVE, AND A CITY COUNCIL MEMBER, PLACE
<br />SIX, SUBMITTING TO THE VOTERS VARIOUS
<br />PROPOSITIONS INCLUDING PROPOSED AMENDMENTS TO
<br />THE CHARTER, SINGLE-MEMBER DISTRICTING
<br />PROPOSITIONS, METHOD OF SELECTION OF THE
<br />MUNICIPAL COURT JUDGE, A STREET ASSESSMENT
<br />PROGRAM AND CITY COUNCIL APPROVAL OF
<br />SUBDIVISION PLATS AFTER THEIR APPROVAL BY THE
<br />PLANNING COMMISSION, AND DECLARING AN
<br />EMERGENCY.

<br />ORDINANCE 1988-36
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />by ordinance duly enacted on February 8, 1988, and amended on
<br />February 10, 1988, March 7, 1988, and March 28, 1988, ordered that
<br />a Special and General election be held on May 7, 1988 for the
<br />purpose of electing a Mayor, City Council member, place five and a
<br />City Council member, place six, and submitting to the voters
<br />various propositions including proposed amendments to the Charter,
<br />single-member districting propositions, method of seleotion of the
<br />Municipal Court Judge, a street
<br />assessment program and city Council approval of subdiv~sion plats
<br />after their approval by the Planning Commission; and,
<br />
<br />WHEREAS, notice of said election was duly published in the
<br />San Marcos News on February 18, 1988, March 10, 1988, and March
<br />31, 1988; and,
<br />
<br />WHEREAS, copies of said notice were duly posted at each city
<br />election precinct polling place prior to said election, and a copy
<br />of same was posted on the bulletin board at City Hall on or before
<br />April 16, 1988; and,
<br />
<br />WHEREAS, said election was duly and legally held on the 7th
<br />day of May, 1988, in conforrni ty with the election laws of the
<br />State of Texas, and the results of said election have been
<br />certified and returned by the proper judges and clerks thereof;
<br />and,
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />with the following members present: J. E. Younger, Karl W. Browp
<br />Fred Guerra, Rick Hernande~, Betty Jane Kissler ,
<br />, Gerald G. Farr and William C. Nicola has today considered the
<br />returns of said Special and General election held on the 7th day
<br />of May, 1988; and,
<br />
<br />WHEREAS, it appears to the Council, and the Council so finds,
<br />that the said election was in all respects lawfully held; and,
<br />
<br />WHEREAS, it appears to the Council, and the Council so finds,
<br />that the tabulation of the results of said election is correct;
<br />now, therefore,
<br />
<br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS:

<br />SECTION 1. That the Special and General City election of
<br />May 7, 1988 was duly called, that notice of said election was
<br />given in accordance with law, and that said election was held in
<br />accordance with law.
<br />
<br />SECTION 2. That the tabulation of votes cast in the
<br />Special and General election held on May 7, 1988 for the purpose
<br />of electing a Mayor, City Council member, place five, and a City
<br />Council member, place six, and submitting to the voters various
<br />propositions including proposed amendments to the Charter,
<br />single-member districting propositions, method of selection of the
<br />Municipal Court Judge, a street assessment program and City
