<br /> <br /> <br /> <br />53 <br /> <br />ORDINANCE 1988-62 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY <br />ZONING ALL THAT CERTAIN TRACT OR PARCEL OF LAND LYING AND <br />AND BEING SITUATED IN HAYS COUNTY', TEXAS, AND BEING THE <br />NORTHEAST PORTION OF LOTS 1 AND 2, OF THE THIRD REVISION <br />OF COLLEGE HEIGHTS ADDITION TO THE CITY OF SAN MARCOS, <br />HAYS COUNTY, TEXAS, ACCORDING TO THE MAP OR PLAT OF SAID <br />REVISION OF RECORD IN VOLUME 144, PAGES 182-184 OF THE <br />DEED RECORDS OF HAYS COUNTY, TEXAS, A/K/A 212 LAMAR STREET <br />FRat" "R-l" (SINGLE-FAMI LY DWELLING-LOW DENSITY) DISTRICT <br />TO "[\1F-3" (MULTI-FAMILY-HIGH DENSITY) DISTRICT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, on July 5,1988 the Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the <br />zoning from "R-l" (Sing le-Fami ly Dwelling- Low Dens i ty) District to <br />"MF-3" (Multi-Fami1y-High Density) District of all that certain <br />tract or parcel of land lying and being situated in Hays County, Texas, <br />and being the Northeast portion of Lots 1 and 2, of the Third <br />Revision of College Heights Addition, to the City of San Marcos, <br />Hays County, Texas; and, <br /> <br />WHEREAS, subsequent to said public hearing on said date, said <br />Commission did, on July 5,1988, consider said request and vote <br />to approve the same and has recommended that such request <br />be approved by the City Council of said City; and, <br /> <br />WHEREAS, said City Council held a public hearing on the <br />of J.<)e;Qt~mh~r , 1988, regarding such request; and, <br /> <br />12 <br /> <br />day <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, said City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />SECTION 1. That the following described tract of real property <br />located in San Marcos, Hays County, Texas, which is presently <br />zoned "R-l" (Single-Family Dwelling-Low Density) District be <br />rezoned "MF-3" (Mu1ti-Family-High Density) District: <br /> <br />All that certaint tract or parcel of land lying and being <br />situated in Hays County, Texas, and being the Northeast portion <br />of Lots 1 and 2, of the Third Revision of COLLEGE HEIGHTS <br />ADDITION to the City of San Marcos, Hays County, Texas, <br />according to the map or plat of said revision of record in <br />Volume 144, pages 182-184 of the Deed Records of Hays County, <br />Texas, being more particularly described by metes and bounds as <br />follows: <br /> <br />BEGINNING at a small copper pipe in a 7-inch concrete curb at <br />the intersection of the Southeast line of Lamar Avenue and the <br />Southwest line of Clark Avenue and at the most Northern corner <br />of Lot One (1) of the Third Revision of College Heights Addition <br />as of record in Volume 144, pages 182-184 of the Deed Records of <br />Hays County, Texas, and Lot One (1) and Two (2) were conveyed by <br />Fritz Moeller to Benno Simon and Connie L. Simon by deed dated <br />August 1, 1951, and of record in Volume 150, pages 493-494 of <br />the Deed Records of Hays County, Texas, and the beginning corner <br />is the most Northern corner of the small tract of land herein <br />described; <br /> <br />THENCE with the Southeast line of Lamar Avenue and the Northwest <br />line of Lot One (1) and the Northwest part of the 7-inch <br />concrete curb, S. 44 degrees 26' W. 73.96 feet to a small copper <br />pipe in the concrete curb; <br /> <br />THENCE with the Southwest edge of a 6-inch concrete curb, S. 45 <br />degrees 14' E. 133.03 feet, passing the Northwest line of Lot <br />Two (2) at 66.82 feet, to a concrete monument on the Northwest <br />line of Lot Three (3) and the Southeast line of Lot Two (2) and <br />
