<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13,1984 (VOL. 66) BY
<br />ZONING A 12.258 ACRE TRACT OF LAND OUT OF THE J.M.
<br />VERAMENDI LEAGUE SURVEY NO.2 AND BEING OUT OF THE
<br />SOUTHWEST PORTION OF A TRACT CALLED 22.650 ACRES CONVEYED
<br />TO BOLLMAN INDUSTRIES, INC. AND RECORDED IN VOLUME 344,
<br />PAGES 53-54 OF THE DEED RECORDS OF HAYS COUNTY, TEXAS,
<br />LOCATED AT 101 UHLAND ROAD FROM "I" (INDUSTRIAL) DISTRICT
<br />TO "LI" (LIGHT INDUSTRIAL) DISTRICT; AND DECLARING AN
<br />EFFECTIVE DATE.
<br />
<br />WHEREAS, on August 16, 1988 the Joint Planning and Zoning
<br />Commissions of the City of San Marcos held a public hearing regarding
<br />a request to change the zoning from "I" (Industrial) District to
<br />"LT" (Light Industrial) District of a 12.258 acre tract of land out
<br />of the J.M. Veramendi League Survey No.2 and being out of the
<br />Southwest portion of a tract called 22.650, to the City of San Marcos,
<br />Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said
<br />Zoning Commission did, on August
<br />vote to approve the same and
<br />request be approved by the
<br />City; and,
<br />
<br />public hearing on said date, said
<br />16, 1988, consider said request and
<br />has recommended that such
<br />City Council of said
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />SeDtember , 1988, regarding such request; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
<br />
<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "I" (Industrial) District be rezoned "LT" (Light
<br />Industrial) District:
<br />
<br />A 12.258 acre tract of land out of the J.M. Veramendi League
<br />Survey No.2 and being out of the Southwest portion of a tract
<br />called 22.650 acres conveyed to Bollman Industries, Inc. and
<br />recorded in Volume 344, Pages 53-54 of the Deed Records of Hays
<br />County, Texas, and being more particularly described as follows:
<br />
<br />BEGINNING: At the south corner of the above referenced tract,
<br />in the Northeast line of a road, called Uhland Road, for the
<br />south corner of this tract;
<br />
<br />THENCE: Along the Northeast line of Uhland Road, N 44 degrees
<br />02' W 791.50 feet to its intersection with the Southeast line of
<br />the Missour-Pacific Railroad, for the West corner of the above
<br />referenced tract, for the West corner of this tract;
<br />
<br />THENCE: Along the Northwest line of the above referenced tract,
<br />on the Southeasterly side of the Missouri-Pacific Railroad, N 45
<br />degrees 15' 00" E 649.0 feet and S 39 degrees 42' 00" E 57.50
<br />feet to an interior corner of the above referenced tract, for an
<br />interior corner of this tract;
<br />
<br />THENCE: Continuing along the Southeasterly side of the
<br />Missouri-Pacific Railroad and a curve to the left, having a
<br />central angle of 00 degrees 09' 29", a radius of 9436.90 feet
<br />and an arc length of 26.0 feet to a point in same for a corner
<br />of this tract, said point also being the West corner of a 10.392
<br />acre tract out of the above referenced tract;
<br />
<br />THENCE: Along the Southwest line of said 10.392 acre tract, S 44
<br />degrees 41' 17" E 727.88 feet to its South corner, in the
<br />Southeast line of the above referenced tract, for the East
<br />corner of this tract;
