û- .-' 73 ORDINANCE 1988-90 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 21, PUBLIC SAFETY, OF THE CODE OF ORDINANCES OF SAID CITY BY TRANSFERRING AND RENUMBERING CERTAIN SECTIONS, CREATING FIVE (5) DIVISIONS WITHIN ARTICLE II, REPEALING ARTICLES II 1/2, IV, AND V, CREATING THREE (3) DIVISIONS WITHIN ARTICLE III, IN ORDER TO PROVIDE FOR SPECIAL ASSIGNMENT SERVICES WITHIN THE POLICE AND FIRE DEPARTMENTS, PROVIDING FOR SEVERABILITY AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That Section 21-15 of Article II 1/2 of Chapter 21 of the Code of Ordinances of said City is hereby renumbered as Section 21-16 and the remaining sections of said Article II 1/2 are hereby renumbered in proper sequential order accordingly. PART 2. That there is hereby created within Article II of Chapter 21 of the Code of Ordinances of the City of San Marcos, Texas, Division 1, General Provisions, which shall consist of present Sections 21-13 throùgh 21-14, Section 21-35 which shall be transferred from Article IV and added as a part of Section 21-14, and Section 21-36 which shall be transferred from Article IV and re-numbered as Section 21-15: and, Police Reserve Force, consisting of Sections 21-16 through 21-23 which shall be transferred from Article II 1/2 and added to said Article II as Division 2 thereunder. PART 3. That Articles II 1/2 and IV of said Chapter of said are hereby repealed. Code PART 4. That there is hereby created within Article II of Chapter 21 of the Code of Ordinances of the City of San Marcos, Texas, Division 3, Special Assignment Services--Off Duty Security Work, which shall contain Sections 21-37 through 21-43, all of which sections shall be re-numbered as Sections 21-24 through 21-30, respectively, and Article Vof Chapter 21 is hereby repealed. PART 5. That there is hereby created within Article II of Chapter 21 of the Code of Ordinances of the City of San Marcos, Texas, Division 4, Special Assignment Services--Police Public Safety Officer, and Division 5, Special Assignment Services--Field Training Officers Program, and said Divisions 4 and 5 shall read as follows: DIVISION 4. SPECIAL ASSIGNMENT SERVICES-- POLICE PUBLIC SAFETY OFFICER Sec. 21-31. Purposes. The purposes of this division are: (1) To assist the fire department in the suppression of and perform other fire fighter activities; fire (2) To distribute services duty equitably among qualified personnel of the San Marcos Police Department; (3) To ensure that officers performing services are in an on- duty status for purposes of workers' compensation, health and medical, disability, pension and retirement coverages and benefits, and all other related purposes: (4) To provide services. a uniform rate of pay for performance of Sec. 21-32. Assignments, number employees, hours of and qualifications of service, and supervision. (a) Up to three (3) employees of the police department holding the rank of police officer and serving in the patrol division of the police department, holding basic certification by the Texas State Firemen's And Fire Marshal's Association, being recommended by the Fire Chief and by the Police Chief and approved by the Director of Public Safety, may perform special assignment services under this division.
