<br /> <br />û- <br />.-' <br /> <br /> <br />73 <br /> <br />ORDINANCE 1988-90 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 21, PUBLIC SAFETY, <br />OF THE CODE OF ORDINANCES OF SAID CITY BY TRANSFERRING <br />AND RENUMBERING CERTAIN SECTIONS, CREATING FIVE (5) <br />DIVISIONS WITHIN ARTICLE II, REPEALING ARTICLES II 1/2, <br />IV, AND V, CREATING THREE (3) DIVISIONS WITHIN ARTICLE <br />III, IN ORDER TO PROVIDE FOR SPECIAL ASSIGNMENT SERVICES <br />WITHIN THE POLICE AND FIRE DEPARTMENTS, PROVIDING FOR <br />SEVERABILITY AND DECLARING AN EFFECTIVE DATE. <br /> <br />BE <br /> <br />IT <br /> <br />ORDAINED <br /> <br />BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. That Section 21-15 of Article II 1/2 of Chapter 21 of <br />the Code of Ordinances of said City is hereby renumbered as Section <br />21-16 and the remaining sections of said Article II 1/2 are hereby <br />renumbered in proper sequential order accordingly. <br /> <br />PART 2. That there is hereby created within Article II of <br />Chapter 21 of the Code of Ordinances of the City of San Marcos, Texas, <br />Division 1, General Provisions, which shall consist of present <br />Sections 21-13 throùgh 21-14, Section 21-35 which shall be <br />transferred from Article IV and added as a part of Section 21-14, and <br />Section 21-36 which shall be transferred from Article IV and <br />re-numbered as Section 21-15: and, Police Reserve Force, consisting <br />of Sections 21-16 through 21-23 which shall be transferred from <br />Article II 1/2 and added to said Article II as Division 2 thereunder. <br /> <br />PART 3. That Articles II 1/2 and IV of said Chapter of said <br />are hereby repealed. <br /> <br />Code <br /> <br />PART 4. That there is hereby created within Article II of <br />Chapter 21 of the Code of Ordinances of the City of San Marcos, Texas, <br />Division 3, Special Assignment Services--Off Duty Security Work, <br />which shall contain Sections 21-37 through 21-43, all of which <br />sections shall be re-numbered as Sections 21-24 through 21-30, <br />respectively, and Article Vof Chapter 21 is hereby repealed. <br /> <br />PART 5. That there is hereby created within Article II of Chapter <br />21 of the Code of Ordinances of the City of San Marcos, Texas, <br />Division 4, Special Assignment Services--Police Public Safety <br />Officer, and Division 5, Special Assignment Services--Field <br />Training Officers Program, and said Divisions 4 and 5 shall <br />read as follows: <br /> <br />DIVISION 4. SPECIAL ASSIGNMENT SERVICES-- <br />POLICE PUBLIC SAFETY OFFICER <br /> <br />Sec. 21-31. <br /> <br />Purposes. <br /> <br />The purposes of this division are: <br /> <br />(1) To assist the fire department in the suppression of <br />and perform other fire fighter activities; <br /> <br />fire <br /> <br />(2) To distribute services duty equitably among qualified <br />personnel of the San Marcos Police Department; <br /> <br />(3) To ensure that officers performing services are in an on- <br />duty status for purposes of workers' compensation, health <br />and medical, disability, pension and retirement coverages <br />and benefits, and all other related purposes: <br /> <br />(4) To provide <br />services. <br /> <br />a uniform <br /> <br />rate <br /> <br />of <br /> <br />pay <br /> <br />for performance <br /> <br />of <br /> <br />Sec. 21-32. <br /> <br />Assignments, number <br />employees, hours of <br /> <br />and qualifications of <br />service, and supervision. <br /> <br />(a) Up to three (3) employees of the police department <br />holding the rank of police officer and serving in the <br />patrol division of the police department, holding basic <br />certification by the Texas State Firemen's And Fire <br />Marshal's Association, being recommended by the Fire Chief <br />and by the Police Chief and approved by the Director of <br />Public Safety, may perform special assignment services <br />under this division. <br />
