<br /> rn <br />~ Lt') 0 <br />~ c::) ~e <br />c::) a: as <br />c-..J w~ <br />W~ 1'""'4 -Ie: <br />~ ~ Oas <br />)-00 <br />c...!) 1-- <br />-0 <br />:::>> 0>- <br /><t .~ <br /><( () <br /> <br />92. <br /> <br />ORDINANCE NO. 2005----.11 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING AN AMENDMENT TO <br />THE FUTURE LAND USE MAP FROM LOW DENSITY <br />RESIDENTIAL TO HIGH DENSITY RESIDENTIAL FOR A <br />1.614 ACRE, MORE OR LESS, TRACT OF LAND LOCATED <br />AT 225 RAMSAY STREET; AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING THIS TRACT <br />FROM "R-l" SINGLE-FAMILY DWELLING DISTRICT (LOW <br />DENSITY) TO "MF-18" MULTIPLE-FAMILY RESIDENTIAL <br />DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On March 22,2005, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from Low Density Residential to High density Residential, and a <br />concurrent request to change the zoning from "R-l" Single-Family Dwelling District (Low <br />Density) to "MF-18" Multiple-Family Residential District, for a 1.614 acre, more or less, tract of <br />land located at 225 Ramsay Street. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on March 22, 2005, and recommended that the <br />requests be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on June 7, 2005 regarding the requests. <br /> <br />4. Subsequent to the public hearing, the City Council considered an ordinance to approve <br />the requests, and referred the ordinance back to the Planning and Zoning Commission for further <br />review of the City Council's concerns regarding transportation and access issues. <br /> <br />5. Since the meeting on June 7, 2005, the City has trimmed the tree which impacted <br />emergency access and the City Fire and Rescue Department has determined that there is now <br />adequate access to the area. <br /> <br />6. On July 26, 2005 the Planning and Zoning Commission discussed the ordinance and <br />determined that the City Council's concerns have been addressed and again recommended that <br />the requests be approved by the City Council of the City. <br /> <br />7. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br /> <br />8.
