<br /> 13 <br /> RESOLUTION 1984-109R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SAN HARCOS, TEXAS AUTHORIZING <br /> AND APPROVING THE TE~1S AND CONDITIONS <br /> OF A COMPLIANCE AGREEMENT BETWEEN SAID <br /> CITY AND THE EXECUTIVE DIRECTOR OF THE <br /> TEXAS DEPARTMENT OF WATER RESOURCES WITH <br /> REGARD TO THE WITHHOLDING OF ENFORCEMENT <br /> ACTION BY TDWR AGAINST SAID CITY FOR AL- <br /> LEGED VIOLATIONS OF THE TEXAS SOLID WASTE <br /> DISPOSAL ACT (TEX.REV.CIV.STAT.ANN., <br /> ART. 4477-7) AND/OR CHAPTER 26 OF THE <br /> TEXAS WATER CODE IF SAID CITY COMPLIES <br /> WITH THE TEro1S OF SUCH AGREEMENT; AUTHORIZING <br /> THE ~AYOR TO EXECUTE SAID COMPLIANCE AGREE- <br /> MENT ON BEHALF OF SAID CITY AND DECLARING <br /> AN EFFECTIVE DATE. <br /> WHEREAS, the Executive Director of the Texas Depart- <br /> ment of Water Resources (TDWR) will withhold formal enforce- <br /> ment action pertaining to alleged violations of the Texas <br /> Solid Waste Disposal Act (Tex.Rev.Civ.Stat.Ann., Art. 4477-7 <br /> (Vernon Supp. 1984», as amended and/or Chapter 26 of the <br /> Texas vJater Code (Tex. Water Code Ann. Vernon Supp. 1984», <br /> as amended, against the City of San Marcos, Texas, if said <br /> City complies with the terms and conditions of a proposed <br /> Compliance Agreement between said City and the Executive <br /> Director of TDWR; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> HARCOS, TEXAS: <br /> PART 1. That the terms and conditions of a proposed <br /> Compliance Agreement between said City and the Executive <br /> Director of the Texas Department of Water Resources with <br /> regard to the withholding of enforcement action by TDWR <br /> against said City for alleged violations of the Texas Solid <br /> Waste Disposal Act and/or Chapter 26 of the Texas Water <br /> Code, are hereby authorized and approved, and a copy of said <br /> Compliance Agreement is attached hereto and incorporated <br /> herein for all purposes. <br /> PART 2. That the Mayor be, and she is hereby, authorized <br /> to execute said Compliance Agreement on behalf of said City. <br /> PART 3.
