RESOLUTION 2014 -137R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AGREEMENT BETWEEN THE <br />CITY AND KIMLEY -HORN AND ASSOCIATES, INC. FOR THE <br />PROVISION OF PROFESSIONAL ENGINEERING SERVICES IN <br />CONNECTION WITH THE CRYSTAL CLEAR CCN WATER LINE <br />IMPROVEMENTS PROJECT IN AN AMOUNT NOT TO EXCEED <br />$156,955.00 CONTINGENT UPON THE CONSULTANT'S PROVISION <br />OF SUFFICIENT INSURANCE IN ACCORDANCE WITH THE <br />ATTACHED AGREEMENT; AUTHORIZING THE CITY MANAGER OR <br />HIS DESIGNEE TO EXECUTE THIS AGREEMENT ON BEHALF OF <br />THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached agreement between the City and Kimley -Horn and Associates, <br />Inc. for the provision of professional engineering services in connection with the Crystal Clear <br />CCN Water Line Improvements Project (the "Project ") in a total not -to- exceed amount of <br />$156,955.00 is approved contingent upon the Consultant's provision of sufficient insurance in <br />accordance with the attached agreement. <br />PART 2. The City Manager or his designee is authorized to execute the Agreement on <br />behalf of the City. <br />PART 3.
