<br />ORDINANCE NO. 2007- 73 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING SECTION 78.102 OF THE SAN MARCOS <br />CITY CODE TO INCREASE THE HOTEL OCCUPANCY TAX FROM <br />SEVEN PERCENT TO NINE PERCENT OF THE PRICE PAID FOR A ROOM, <br />EFFECTIVE JANUARY 1, 2008; PROVIDING THAT REVENUE <br />COLLECTED FROM THE TWO PERCENT INCREASE IN THE HOTEL <br />OCCUPANCY TAX RATE SHALL BE DEPOSITED INTO THE SAN <br />MARCOS CONFERENCE CENTER VENUE PROJECT FUND; AND <br />DECLARING AN EMERGENCY <br /> <br />RECITALS: <br /> <br />1. At a special election held on November 6, 2007, a proposition was adopted to <br />authorize an increase in the hotel occupancy tax from seven percent to nine percent to establish <br />and fund the San Marcos Conference Center as a venue project. <br /> <br />2. The City of San Marcos has issued obligations to construct the San Marcos Conference <br />Center. <br />3. The City Council wishes to impose a venue tax of two percent of the price of a hotel <br />room and establish the San Marcos Conference Center Venue Project Fund pursuant to <br />S334.257 and S334.258 of the Texas Local Government Code. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 78.102 of the San Marcos City Code is hereby amended to read as <br />follows: (underlininQ indicates added text; overstrike indicates deleted text): <br /> <br />Section 78.102. Levy and Collection. <br /> <br />(a) A tax is imposed on each person who, under a lease, concession, permit, right <br />of access, license, contract, or agreement, pays for the use or possession or for <br />the right to the use or possession of a room that is in a hotel that costs $2.00 or <br />more each day and that is ordinarily used for sleeping. <br />(b) The tax shall be sevefl-nine percent of the price paid for the room. A nortion of <br />the revenue collected from the tax hereby imnosed.. in an amount eaual to two <br />nercent of the nrice naid for a room.. shall be denosited into the San Marcos <br />Conference Center Venue Proiect Fund and shall be used for the sole nurnose <br />of nayinQ nrincinal and interest on any outstandinQ bonds or other obliQations <br />issued to fund construction of the San Marcos Conference Center. The price of <br />a room does not include the cost of food served by the hotel and the cost of <br />personal services performed by the hotel for the person, except those services <br />related to cleaning and readying the room for use or possession. <br /> <br />Page 1 of2 <br />
