ORDINANCE NO. 2009 -81 <br />• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE <br />LAND USE MAP FROM "VLDR" VERY LOW DENSITY RESIDENTIAL, <br />"LDR" LOW DENSITY RESIDENTIAL, AND "OS" OPEN SPACE TO "MU" <br />MIXED USE FOR A 101.40 ACRE MORE OR LESS, TRACT OF LAND OUT <br />OF THE J.M. VERAMENDI SURVEY NO. 1, ABSTRACT NO. 17; <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY CHANGING <br />THE BASE ZONING FOR SAID TRACT FROM "SF -6" SINGLE- FAMILY <br />RESIDENTIAL DISTRICT TO "PDD" PLANNED DEVELOPMENT <br />DISTRICT WITH "MU" MIXED USE BASE ZONING; AND APPROVING A <br />LAND USE PLAN AND DEVELOPMENT STANDARDS FOR THE <br />RETREAT ON WILLOW CREEK PLANNED DEVELOPMENT DISTRICT <br />LOCATED ON SAID TRACT OF LAND; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br />RECITALS: <br />1. On October 27, 2009, the City Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the Future Land Use Map of the San <br />Marcos Horizons City Master Plan from "VLDR" Very Low Density Residential, "LDR" Low <br />Density Residential, and "OS" Open Space to "MU" Mixed Use for a 101.40 acre, more or less, <br />• tract of land out of the J.M. Veramendi Survey No. 1, Abstract 17, located at the west side of <br />Hunter Road at the terminus of Foxtail and the south side of Stagecoach at the terminus of <br />Hunter's Hill Drive. <br />2. On October 27, 2009, concurrently with the consideration of the land use <br />amendments, the Planning and Zoning Commission of the City of San Marcos held a public <br />hearing regarding a request to change the base zoning for the 101.40 acre, more or less, tract of <br />land described above in paragraph 1, from "SF -6" Single - Family District to "PDD" Planned <br />Development District with base zoning of "MU" Mixed Use to be known as the Retreat on <br />Willow Creek Planned Development District. <br />3. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on October 27, 2009, consider and vote to approve the requests, and has recommended that <br />the requests be approved by the City Council of the City of San Marcos. <br />4. The City Council held a public hearing on November 17, 2009, regarding the requests. <br />5. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />6. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />
