ORDINANCE NO. 2009 -81 • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM "VLDR" VERY LOW DENSITY RESIDENTIAL, "LDR" LOW DENSITY RESIDENTIAL, AND "OS" OPEN SPACE TO "MU" MIXED USE FOR A 101.40 ACRE MORE OR LESS, TRACT OF LAND OUT OF THE J.M. VERAMENDI SURVEY NO. 1, ABSTRACT NO. 17; AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY CHANGING THE BASE ZONING FOR SAID TRACT FROM "SF -6" SINGLE- FAMILY RESIDENTIAL DISTRICT TO "PDD" PLANNED DEVELOPMENT DISTRICT WITH "MU" MIXED USE BASE ZONING; AND APPROVING A LAND USE PLAN AND DEVELOPMENT STANDARDS FOR THE RETREAT ON WILLOW CREEK PLANNED DEVELOPMENT DISTRICT LOCATED ON SAID TRACT OF LAND; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. On October 27, 2009, the City Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the Future Land Use Map of the San Marcos Horizons City Master Plan from "VLDR" Very Low Density Residential, "LDR" Low Density Residential, and "OS" Open Space to "MU" Mixed Use for a 101.40 acre, more or less, • tract of land out of the J.M. Veramendi Survey No. 1, Abstract 17, located at the west side of Hunter Road at the terminus of Foxtail and the south side of Stagecoach at the terminus of Hunter's Hill Drive. 2. On October 27, 2009, concurrently with the consideration of the land use amendments, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the base zoning for the 101.40 acre, more or less, tract of land described above in paragraph 1, from "SF -6" Single - Family District to "PDD" Planned Development District with base zoning of "MU" Mixed Use to be known as the Retreat on Willow Creek Planned Development District. 3. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on October 27, 2009, consider and vote to approve the requests, and has recommended that the requests be approved by the City Council of the City of San Marcos. 4. The City Council held a public hearing on November 17, 2009, regarding the requests. 5. All requirements of Chapter 1, Development Procedures, of the City Land Development Code pertaining to Future Land Use Map Amendments and Zoning Map amendments have been met. 6. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety.
