<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, Ar-1ENDING SECTION 3 OF THAT ORDINANCE vmICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING 62.19 ACRES OF LAND OUT OF THE T.J. CHAMBERS LEAGUE
<br />AND THE J.~1. VERAMENDI LEAGUE NO.2 IN HAYS COUNTY, TEXAS,
<br />BEING ALL OF THAT CERTAIN 39.81 ACRE TRACT CONVEYED TO
<br />KENNETH M. BROWN, ET. AL BY DEED RECORDED IN VOLUME 159,
<br />PAGE 91 OF THE DEED RECORDS OF HAYS COUNTY, TEXAS AND
<br />BEING ALL OF THAT CERTAIN 23.2 ACRE TRACT CONVEYED TO
<br />KENNETH M. BROWN BY DEED RECORDED IN VOLUME 159, PAGE
<br />93 OF THE DEED RECORDS OF HAYS COUNTY, TEXAS, LOCATED
<br />NORTHWEST OF POST ROAD ON BERT BROWN ROAD FROM 11M" (SINGLE
<br />FAMI LY, DUPLEX AND NEIGHBORHOOD BUSINESSES DISTRICT) TO "P"
<br />(PUBLIC USE DISTRICT); AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on September 1,1987 the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change
<br />the zoning from "M" (Single Family, Duplex and Neighborhood
<br />Businesses District) to "P" (Public Use District) of 62.19 acres
<br />of land out of the T. J. Chambers League and the J.)'v1. Veramendi
<br />League No.2, to the City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on September 1, 1987, consider said request and voted
<br />to approve the same and has recommended that such request be
<br />approved by the City Council of said City; and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />October, 1987, renardinn such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"M" (Single Family, Duplex and Neighborhood Businesses District)
<br />be rezoned "P" (Public Use District):
<br />
<br />FIELD NOTES TO 62.19 ACRES OF LAND OUT OF THE T.J. CHAMBERS

<br />BEING ALL OF THAT CERTAIN 39.81 ACRE TRACT CONVEYED TO KENNETH
<br />M. BROWN, ET. AL. BY DEED RECORDED IN VOLUME 159, PAGE 91 OF THE
<br />DEED RECORDS OF HAYS COUNTY, TEXAS, AND BEING ALL OF THAT
<br />CERTAI N 23.2 ACRE TRACT CONVEYED TO KENNETH ~1. BROWN BY DEED
<br />RECORDED IN VOLUME 159, PAGE 93 OF THE DEED RECORDS OF HAYS
<br />COUNTY, TEXAS AND BEING MORE PARTICULARLY DESCRIBED BY METES AND
<br />BOUNDS AS FO LLOv-JS :

<br />BEGINNING at an iron rod set in the South line of Lime Kiln Road
<br />at the most northerly corner of that certain 18.63 acres
<br />conveyed to San Marcos Independent School District in Volume
<br />155, Page 579 of the Deed Records of Hays County, Texas and
<br />being the East corner of that certain 23.2 acre tract conveyed
<br />to Kenneth M. Brown by deed recorded in Volume 159, Page 93 of
<br />the Deed Records of Hays County, Texas for the most easterly
<br />corner of the tract herein described,
<br />
<br />THENCE, with the Northwest line of the said San Marcos
<br />Independent School District tract and the Southeast line of the
<br />said 23.2 acre tract S 32 degrees 241 W. 882.10 feet to an iron
<br />rod set in pavement in the Northeast line of a paved road at
<br />the West corner said school tract and the South corner of said
<br />Brown 23.2 acre tract for the South corner of this tract,
<br />
<br />THENCE, with the Southwest line of said 23.2 acre tract along
<br />the Northwest line of a paved road, N 51 degrees 54' W, 491.40
<br />feet to an iron rod set at the ell corner of said 23.2 acre
<br />
