;). i'1 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS~ AUGUST 23, 1971 Present: Mayor Herbert A. larbrough, jr. Councilmen: Guillermo De La Rosa Frances D. Emery Eddy A. Aguirre, Jerri Martin, Lanny Cravy, Ismael Gil, Don Trapagnier, Dottie Sims The Mayor called ~he meeting to order at 7:30 p.m. Councilman King gave the Invocation. The Minutes, of August 9, 1971 were approved as presented, on motion of Mr. Flores, and second of Mr. Etheredge. The Minutes of Special Meetings of August 11,13 & 16, 1971, were approved as presented, with Councilman King abstaining because he was absent from the meetings. I The Mayor opened a public hearing ana request for change of zoning from -R-1" (single-family residential) to PC" (commercial) on property owned by Nick Lara at 1521 West Hopkins Street, described as: lots 5,6 & 7, Blk. ~, ~.H. Combs Subdivision. Mr,. Lara said Planning & Zoning Commission ,had turned down his initial request .for a change of zoning, after a public 'hearing which he did not attend. He wished to know why it was denied. The Mayor read aloud the reasons for the Commission's action, as forwarded in a letter to the Council. The chief reason was that it would constitute "spot zoning", 'and would not be consistent with the Comprehensive Plan. It was brought out in the discussion that Mr. Lara has operated a carpet service for many years under a "non-conforming use", provided by the Zoning Ordinance. He now wishes to put some mobile homes on the property, which would con- stitute a violation. Dr. Tauch expressed, the' opinion that the matter should be returned to the Planning: & Zoning' Commission with a request that a study be made of the feasibility of rezoning a larger area around Mr. lara" a pro'perty to commercial use. I There being no further comment, the Mayor declared 'the hearing closed. The Mayor opened a public hearing on a request from the Planning & Zoning Commission that eight tracts of land out of the T.J. Chambers Survey be rel<oned from "R~l" (residential) to "D" (multi-family). Property description is as follows:
