<br />57 <br /> <br />ORDINANCE NO. 1974 - 51 <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 18 OF THE CODE <br />OF ORDINANCES OF SAID CITY ENTITLED <br />"PARKS AND RECREATION," BY ENACTING A <br />NEW SECTION NUMBERED 18-3 ENTITLED <br />"CARE AND CUSTODY OF MINOR CHILDREN <br />AT CITY POOLS." <br /> <br />I <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That a new Section 18-3, Chapter 18 entitled <br /> <br />"Care and Custody of Minor Children at City Pools" be, and is hereby, <br /> <br />enacted so as to read as follows: <br /> <br />"PART l. That it shall be unlawful for the parent, <br />guardian, or person in custody of any minor child who is <br />unable to swim to allow, suffer, or permit such child to <br />go into any swimming pool owned or operated by the City <br />of San Marcos unless such child is accompanied by a <br />person not less than 14 years of age who is capable of <br />supervising and caring for such child, and who has agreed <br />with such parent, guardian, or person in custody of such <br />child to be responsible for the safety of such child. <br /> <br />I <br /> <br />PART 2. That for the purpose of this ordinance, " a minor <br />child who is unable to swim" is a child under the age of <br />twelve years who is unable to complete, with reasonable <br />ease, the beginner's swimming tests set forth as Items 19 <br />and 20 in the American National Red Cross Water Safety <br />Instructor's Manual on Swimming and Lifesaving, 1973 <br />Edition, a copy of which is attached hereto marked Exhibit <br />"A" and made a part hereof. <br /> <br />PART 3. That this section shall not apply to children who <br />are participating in swimming classes being conducted by <br />qualified swimming instructors and being held under the <br />auspices of the San Marcos Parks and Recreation Department." <br /> <br />SECTION 2.
