252. <br /> <br /> W 0.9,. <br /> ORDINANCE NO. 2004- 32 <br /> <br /> ~ AN ORDINANCE OF THE CITY COUNCIL OF THE <br /> o CITY OF SAN MARCOS, TEXAS, AMENDING <br /> CHAPTER 14, BUILDINGS AND BUILDING <br /> REGULATIONS, OF THE SAN MARCOS CITY <br /> CODE, TO CHANGE THE INSURANCE AND <br /> TESTING REQUIREMENTS FOR BUILDING <br /> CONTRACTOR LICENSING; INCLUDING <br /> PROCEDURAL PROVISIONS. <br /> <br />~RECITALS: <br /> <br /> 1. The City regulations for building contractors, including liability <br /> insurance, are intended to help ensure quality construction and construction code <br /> compliance for residences and businesses in the City. <br /> <br /> 2. The City Council wishes to exempt from contractor insurance <br />requirements a person constructing a single family residence on property owned <br />by him or her and to be occupied as the person's homestead. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL <br />MARCOS, TEXAS: <br />SECTION <br /> <br />OF THE CITY OF SAN <br /> <br /> SECTION 1. Section 14.009 of the San Marcos City Code is repealed and <br />reserved for future use. <br /> <br /> SECTION 2. Section 14.375 of the San Marcos City Code is added to <br />read as follows: <br /> <br />Sec. 14.375. Certificate of insurance required for contractors. <br /> <br />(a) A person who applies for a building contractor's license shall provide <br />the inspection division a certificate of insurance that meets the <br />requirements of subsection (b) of this section. The building inspection <br />division will not issue a license until it receives the certificate of insurance. <br /> <br />(b) A certificate of insurance shall: <br /> <br />(1) be written by a company licensed to do business in the State of <br />Texas; <br /> <br /> <br />
