• ORDINANCE NOS. 2010 -69 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE <br />LAND USE MAP FROM "C" COMMERCIAL TO "MDR" MEDIUM <br />DENSITY RESIDENTIAL FOR A 3.41 ACRE, MORE OR LESS, PARCEL <br />OF LAND OUT OF LOT 35 OF THE PARK AT WILLOW CREED <br />SUBDIVISION LOCATED AT 330 STAGECOACH TRAIL; AMENDING <br />THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 3.22 <br />ACRE, MORE OR LESS, PORTION OF SAID PARCEL FROM "OP" <br />OFFICE PROFESSIONAL DISTRICT TO "SF4.5" SINGLE - FAMILY <br />DISTRICT AND THE REMAINING 0.19 ACRE, MORE OR LESS, <br />PORTION OF SAID PARCEL FROM "OP" OFFICE PROFESSIONSL <br />DISTRICT TO "TH" TOWNHOUSE RESIDENTIAL DISTRICT; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. On October 26, 2010, the City Planning and Zoning Commission of the City of <br />San Marcos held public hearings regarding Lot 35 of the Park at Willow Creek Subdivision <br />located at 330 Stagecoach Trail as follows: <br />(a) regarding a request to change the Future Land Use Map of the San Marcos <br />• Horizons City Master Plan from "C" Commercial to "MDR" Medium Density <br />Residential for a 3.41 acre, more or less, parcel out of said lot as described in the attached <br />Exhibits "A" and `B "; <br />(b) regarding a request to change the zoning for a 3.22 acre portion of said <br />parcel, as described in Exhibit "A ", from "OP" Office Professional District to "SF -4.5" <br />Single - Family District ( "Tract A "); and <br />(c) regarding a request to change the zoning for the remaining 0.19 acre, more <br />or less portion of said parcel, as described in Exhibit "B ", from "OP" Office Professional <br />District to "TH" Townhouse Residential District ( "Tract B "). <br />2. Subsequent to the public hearings on that date, the Planning and Zoning <br />Commission considered and voted to approve the requests on October 26, 2010, and <br />recommended that the requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on December 7, 2010, regarding the <br />requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />• <br />
