In Ordinance No. 2005-36 (the "Notice Ordinance"), the City Council approved a process gr conductingjoint public hearings with the Planning and Zoning Commission for consideration of a proposed new Official Zoning Map for the City, under Section 211.007(b) of the Texas Local Government Code. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AND ADOPTING A NEW OFFICIAL CITY ZONING MAP FOR THE CITY; MAKING CONCURRENT AMENDMENTS TO THE FUTURE LAND USE MAP; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 2. In accordance with the Notice Ordinance, notices (the "Published Notices") were published in a newspaper of general circulation in the City of j oint public hearings to be conducted by the City Council and Planning and Zoning Commission held on June 7, 2005 and on August 16, 2005 on a proposed new Official Zoning Map for the City; and in addition to the Published Notices, the Planning and Development Services Department mailed notices (the "Mailed Notices") of the public hearings to approximately 10,600 owners of real property in the City. 3. In accordance with the Notice Ordinance, the Published Notices and the Mailed Notices, the City Council and Planning and Zoning Commission held ajoint public hearing on June 7,2005 on a proposed new Official Zoning Map for the City. 4. The Planning and Zoning Commission considered and voted to approve a new Official Zoning Map for the City on July 12,2005, and recommended that the new Official Zoning Map for the City, and concurrent amendments to the Future Land Use Map, be approved by the City Council. 5. In accordance with the Notice Ordinance, the Published Notices and the Mailed Notices, the City Council and Planning and Zoning Commission held a joint public hearing on August 16, 2005 on the new Official Zoning Map for the City as recommended by the Commission. 6. All requirements of Chapter 1, Development Procedures, of the City Land Development Code pertaining to Zoning Map amendments and amendments to the Future Land Use Map have been met, to the extent these requirements were not superseded by the Notice Ordinance. 7. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The above Recitals are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety.
