<br /> ~ ...".. <br /> CH c:::> <br /> c:::> <br /> C'-..J <br />I W-8 CD <br />...Jo C> <br />u::et I- <br />u <br />!c 0 <br /> <br />I <br /> <br />67. <br /> <br />(/) <br />o <br />~ ~ <br />a: <tl <br />~ ~ ORDINANCE NO. 2004-~ <br /><.)~ <br />~ ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /><.) ~ MARCOS, TEXAS, ORDAINING THE CITY'S PARTICIPATION IN <br />(3 THE TEXAS ENTERPRISE ZONE PROGRAM PURSUANT TO THE <br />TEXAS ENTERPRISE ZONE ACT, CHAPTER 2303, TEXAS <br />GOVERNMENT CODE; PROVIDING FOR TAX INCENTIVES; <br />DESIGNATING A LIAISON FOR COMMUNICATION WITH <br />INTERESTED PARTIES; NOMINATING A MANUFACTURING <br />FACILITY PROJECT IN SAN MARCOS PROPOSED BY GENL YTE <br />THOMAS GROUP, LLC, WIDE-LITE DIVISION, TO THE OFFICE <br />OF THE GOVERNOR, DIVISION OF ECONOMIC DEVELOPMENT <br />AND TOURISM, THROUGH THE ECONOMIC DEVELOPMENT <br />BANK AS AN ENTERPRISE PROJECT; INCLUDING <br />PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />RECITALS: <br /> <br />1. WHEREAS, the City Council of the City of San Marcos, Texas (the "City") desires <br />to create the proper economic and social environment to induce the investment of private <br />resources in productive business enterprises located in severely distressed areas of the City <br />and to provide employment to residents of such area; and <br /> <br />2. WHEREAS, the manufacturing facility proposed to be constructed on Clovis <br />Barker Road (the "Project") by Genlyte Thomas Group, LLC, Wide-Lite Division ("Wide- <br />Lite") is not located in an area presently designated as an enterprise zone under the Texas <br />Enterprise Zone Act, Chapter 2303 of the Texas Government Code (the "Act"); and <br /> <br />3. WHEREAS, pursuant to Chapter 2303, Subchapter F of the Act, Wide-Lite has <br />applied to the City for designation of the Project as an enterprise project; and <br /> <br />4. WHEREAS, the City finds that the Project meets the City's Economic <br />Development Incentives Policy on the grounds that it will be located at the qualified business <br />site, and will create a higher level of employment, economic activity and stability; and <br /> <br />5. WHEREAS, a public hearing on the adoption of this ordinance was held by the <br />City Council on October 11, 2004; now, therefore <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />I <br /> <br />SECTION 1. The City nominates the Project for enterprise project status. <br /> <br />SECTION 2. The following local incentives, at the election of the governing body, <br />are or will be made available to qualified businesses upon approval of this ordinance: <br />
