II I II 26 RESOLUTION NO. 1980-89R A RESOUUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A LEASE AGREE- MENT FOR A SOLID WASTE DISPOSAL SITE IN HAYS COUNTY, TEXAS BETWEEN SAID CITY AND JOHN YARRINGTON; AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE SAID AGREEMENT AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas wishes to acquire a site suitable for the disposal of solid waste, which site is sufficient to serve the present and future needs of the citizens of San Marcos; and, WHEREAS, said City has caused certain tests and studies to be conducted on premises in Hays County owned by John Yarrington to determine the suitability of said premises for a solid waste disposal site; and, WHEREAS, said premises the results of those tests and studies indicate that are suitable for such a site; and, WHEREAS, a permit from the Texas Department of Health is necessary for the use of said premises as a municipal solid waste disposal site; and, WHEREAS, the City Council of said City wishes to lease the premises owned by John Yarrington when and if said site receives a permit for use as a solid waste disposal site; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the lease of waste disposal site for premises located in Hays County, Texas, between the City of San Marcos, Texas and John Yarrington, a copy of which is attached hereto and incorporated herein for all intents and purposes, be, and is here- by, approved. PART 2. That the Mayor of the City of San Marcos, Texas, Kenneth V. Kraus, or his successor, be and he is hereby, authorized to execute said lease agreement on behalf of said City. PART 3.
