The Planning and Zoning Commission conducted public hearings on October 22, 2002 <br /> <br />and on May 27, 2003 regarding amendments to the Signs Chapter of the City Code regarding <br />nonconforming signs and off-premises signs, and has recolranended that the amendments be <br />approved by the City Council. <br /> <br />2. The City Council held a public hearing on the proposed amendments on June 9, 2003. <br /> <br /> 3. All requirements of the City Code m~d of State Law pertaining to sign ordinance <br />amendments have been inet, and the City Council finds mhd determines that the adoption of this <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br /> BE IT ORDAiNED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. Section 106.009 of the City Code is amended as follows (underlining <br />indicates added text and ........... indicates deleted text): <br /> <br />Sec. 106.009. Abandonment. <br /> <br />L~} When m~y sign contains infbrmation that is no longer current, the property owner shall <br />remove the sign or the copy, cover the copy, or change the copy to current information within <br />30 days, except as otherwise provided in this chapter. <br /> <br />(b~ When an on-premises sign is nonconforming with respect to any section of this chapter and <br />use of the premises ceases for a period of 12 months, the sigu shall be brought into conformance <br />by the property owner. <br /> <br />(c) When an off-premises sign has copy which is subject to a lease for a specified period and <br />the lease is pm'chased in advance, the copy may remain through the contract period if it is <br />maintained in good condition. <br /> <br /> SECTION 2.
