<br />15 <br /> <br /> <br />RESOLUTION 1995- 131 R <br /> <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AMENDMENT NO . 2 TO THE <br />REAL ESTATE CONTRACT BETWEEN THE CITY AND SOUTHWEST <br />TEXAS STATE UNIVERSITY SUPPORT FOUNDATION REGARDING <br />RIO VISTA DAM AND ADJACENT PROPERTY; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THE AMENDMENT ON BEHALF <br />OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br /> <br />j <br />RECITALS: <br /> <br />1. In July 1993, the City of San Marcos submitted <br />a grant application to the Texas Parks and Wildlife <br />Department (TPWD) for the acquisition and development of the <br />Rio Vista Dam and adjacent property. <br /> <br />2~' On June 12, 1995, the City Council approved a <br />project agreement with TPWD for this acquisition and <br />development. <br /> <br />3. A delay in the obtaining of certain closing <br />documents has created a need to extend the closing deadline <br />in the City's contract for this property acquisition with <br />Southwest Texas State University Support Foundation. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />PART 1. That Amendment No.2 to the Real Estate <br />Contract between the City and Southwest Texas State <br />University Support Foundation, a copy of which is attached to <br />and incorporated in this Resolution for all intents and <br />purposes, is approved. <br /> <br />PART 2. That the City Manager, Larry D. Gilley, is <br />authorized to execute the Amendment on behalf of the City. <br /> <br />PART 3.
