<br /> 45 <br /> RESOLUTION 1995- lRf1 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS <br /> OF AN AGREEMENT BETWEEN THE CITY AND SOUTHWEST <br /> TEXAS STATE UNIVERSITY REGARDING THE PECAN STREET <br /> RIGHT-OF-WAY; AUTHORIZING THE CITY MANAGER TO <br /> EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City owns the Pecan Street right-of-way Southeast of Sessom Drive <br /> extending to Liv.e Oak Street. <br /> 2. Southwest Texas State University (the "University") has requested the <br /> abandonment of this segment of Pecan Street, and wishes to execute an agreement with <br /> the City regarding the abandonment, and improvements the University wishes to make to <br /> the roadway in the segment. <br /> { <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of the Agreement attached to this <br /> Resolution between the City and the University regarding the Pecan Street right-of-way <br /> between Sessom Drive and Live Oak Street are approved. <br /> PART 2. That the City Manager, Larry D. Gilley, is authorized to execute this <br /> Agreement on behalf of the City. <br /> PART 3.
