Sa <br />ORDINANCE 1994- 46 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING ARTICLE IA, WATER <br />CONSERVATION, OF CHAPTER 30, WATER AND SEWERS AND <br />SEWAGE DISPOSAL, OF THE SAN MARCOS CODE OF <br />ORDINANCES TO INCREASE THE EDWARDS AQUIFER LEVELS <br />AT WHICH STAGES 1 THROUGH 4 OF THE CITY'S WATER <br />CONSERVATION REGULATIONS MAY BE IMPLEMENTED; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING A PENALTY; <br />PROVIDING FOR PUBLICATION; DECLARING AN EMERGENCY <br />AND PROVIDING AN EFFECTIVE DATE. <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: - . <br /> <br />SECTION 1. That section 30-11(a) of the San Marcos Code of <br />Ordinances is amended to read as follows: <br /> <br />(a) The mayor or city manager is authorized to implement <br />stage 1 (aquifer awareness) of the San Marcos Water <br />Conservation Plan when the aquifer level as~easured in the <br />index well is between 660 feet above mean sea level and 650 <br />feet above mean sea level. The mayor or city manager is <br />further authorized to terminate stage 1 (aquifer awareness) <br />based upon an appropriate change in the water level of the <br />index well. The order to implement and to terminate stage <br />1 (aquifer awareness) shall be made by public announcement <br />and shall be published at least one (1) time in a newspaper <br />of general circulation in the city. <br /> <br />SECTION 2. That section 30-12(a) of the San Marcos Code of <br />Ordinances is amended to read as follows: <br /> <br />(a) The mayor or city manager is authorized to implement <br />stage 2 (aquifer watch) of the San Marcos Water <br />Conservation Plan when the aquifer level as measured in the <br />index well is between 650 feet above mean sea level and 635 <br />feet above mean sea level. The mayor or city manager is <br />further authorized to terminate stage 2 (aquifer watch) <br />based upon an appropriate change in the water level of the <br />index well. The order to implement and to terminate stage <br />2 (aquifer watch) shall be made by public announcement and <br />shall be published a minimum of one (1) time in a newspaper <br />of general circulation in the city. <br /> <br />SECTION 3. That section 30-13(a) of the San Marcos Code of <br />Ordinances is amended to read as follows: <br /> <br />(a) The mayor or city manager is authorized to implement <br />stage 3 (aquifer alert) of the San Marcos Water <br />Conservation Plan when the aquifer level as measured in the <br />index well is between 635 feet above mean sea level and 625 <br />feet above mean sea level. The mayor or city manager is <br />further authorized to terminate stage 3 (aquifer alert) <br />¡ based upon an appropriate change in the water level of the <br />¡ index well. The order to implement and to terminate stage <br />3 (aquifer alert) shall be made by public announcement and <br />shall be published at least one (1) time in a newspaper of <br />general circulation in the city. <br /> <br />SECTION 4. That section 30-14(a) of the San Marcos Code of <br />Ordinances is amended to read as follows: <br /> <br />(a) The mayor or city manager is authorized to implement <br />stage 4 (aquifer risk) of the San Marcos Water Conservation <br />Plan when the aquifer level as measured in the index well <br />is at or below 625 feet above mean sea level.
