4 . .- '.- RESOLUTION 1993- 97 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A SUPPLEMENTAL ELECTRIC SERVICE AGREEMENT BETWEEN THE CITY AND SOUTHWEST TEXAS STATE UNIVERSITY; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. i . WHEREAS, the city has developed and adopted a special retail electric rate schedule applicable to electric service provided by City to supplement the electric power and energy requirements of customers owning and operating electric generation equipment located on their premises, subject to a special contract for such service; and, WHEREAS'~' Southwest Texas State University (SWTSU) has installed a cogeneration facility located on SWTSU's premises at the corner of Live Oak and Pecan Streets, San Marcos, Texas and desires to contract with the city for the purchase of electric power and energy to supplement the electric power and energy requirements supplied by SWTSU's cogeneration facility; and, WHEREAS, the City agrees to provide such supplemental electric service to SWTSU pursuant to the rates and charges and terms and conditions of the City's supplemental Electric Service Rate Schedule COG and the terms and conditions of this Agreement; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions of the Supplemental Electric Service Agreement attached to this Resolution between the city and Southwest Texas State Univ~rsity are hereby approved. PART 2. That the city Manager, Larry D. Gilley, is hereby authorized to execute this Agreement on behalf of the city. PART 3.
