<br /> 78 <br /> - <br /> ~ <br /> ~ <br /> ~ <br /> 0 <br /> ORDINANCE 1991- 55 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS REVISING AND UPDATING <br /> ARTICLE III, INDUSTRIAL WASTE REGULATIONS, OF <br /> CHAPTER 30, WATER AND SEWERS AND SEWAGE <br /> DISPOSAL, OF THE SAN MARCOS CODE OF <br /> ORDINANCES; PROVIDING FOR SEVERABILITY; <br /> REPEALING ALL CONFLICTING ORDINANCES; <br /> PROVIDING A PENALTY; PROVIDING FOR <br /> PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. <br /> WHEREAS, the United States Environmental Protection Agency and <br /> the Texas Water Commission have requested the City to revise and <br /> update its ordinance regulating the discharge of industrial waste <br /> into the City sanitary sewer and treatment plant facilities; now, <br /> therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That Article III, Industrial Waste of Chapter 30, <br /> Water and Sewers and Sewage Disposal, of the San Marcos Code of <br /> Ordinances, is hereby amended to read as follows: <br /> ARTICLE III. INDUSTRIAL WASTE DISCHARGE REGULATIONS <br /> Sec. 30-90. ComDliance with other authority. <br /> <br /> (a) Compliance with Federal Authority: <br /> The city shall comply with, enforce and adopt all Federal <br /> General Pretreatment Regulations and Federal Categorical <br /> Pretreatment Regulations, including the implementation of a <br /> Pretreatment Program approved by the U. S. Environmental <br /> Protection agency. <br /> (b) Compliance with state Authority: <br /> The city shall comply with, enforce and adopt all <br /> applicable sections of Chapter 26 of the Texas Water Code. <br /> Sec. 30-91. Definitions. <br /> Except as defined below, all terms used in this section <br /> are as defined in Title 40 Code of Federal Regulations, Part <br /> 403 which is adopted hereby and incorporated by reference <br /> herein and a copy of which shall be maintained in the office <br /> of the City Secretary of the city. <br /> (1) Abnormal industrial waste: Any industrial waste <br /> having aSS, COD, or BOD content in excess of that <br /> found in normal waste, but which is otherwise <br /> acceptable into a sanitary sewer under the terms of <br /> this Article. <br /> (2) Act: The Federal Water Pollution Control Act, as <br /> amended, 33 U.S.C. 1251 et seq., 86 stat. 816, Pub. <br /> L. 92-500. <br /> (3) Approval authority: The U. S. Environmental <br /> Protection Agency and/or Texas Water Commission. <br /> (4) Approved methods: The analytical procedures <br /> published by the u.S. Environmental Protection <br /> Agency in 40 CFR 136. <br />
