<br />- 53 <br />~- <br />1..:5.- <br />-- <br />Ci <br />(\.1 <br /> ORDINANCE 1991- 73 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING CHAPTER 30, WATER <br /> AND SEWERS AND SEWAGE DISPOSAL, SECTION 30- <br /> 92(b)(5), OF THE SAN MARCOS CODE OF ORDINANCES <br /> TO CHANGE THE MAXIMUM CONCENTRATION LIMIT FOR <br /> THE PARAMETER ZINC; REPEALING CONFLICTING <br /> ORDINANCES; PROVIDING FOR A PENALTY; PROVIDING <br /> FOR PUBLICATION AND DECLARING AN EMERGENCY. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That Chapter 30, Water and Sewer and Sewage <br /> Disposal, section 30-92(b) (5), of the San Marcos Code of Ordinances <br /> is hereby amended as follows: <br /> Sec. 30-92. Discharqe limitations and prohibitions. <br /> <br /> . .. <br /> (b) Specific Discharge Limitations: <br /> (5) Any of the following elements in solution or <br /> suspension in total concentrations exceeding the <br /> limits set as follows: <br /> PARAMETERS MAXIMUM CONCENTRATION LIMIT <br /> ALLOWABLE, mq/l (Total) <br /> Cyanide 0.74 <br /> Arsenic 1.15 <br /> Cadmium 3.55 <br /> Chromium 11.29 <br /> Copper 11.17 <br /> Lead 0.65 <br /> Mercury 0.01 <br /> Nickel 11.6 <br /> Silver 0.306 <br /> Zinc 1.6 <br /> SECTION 2. That all ordinances and resolutions or parts of <br /> ordinances or resolutions in conflict herewith are hereby repealed. <br /> SECTION 3. (a) Any person who violates this may be fined not <br /> less than one hundred dollars ($100.00) nor more than the maximum <br /> allowed by the Texas Water Code, Section 26.213, and each day that <br /> such violation occurs or continues shall constitute a separate <br /> offense. The Control Authority, as defined in Chapter 30, Article <br /> III of the San Marcos Code of Ordinances, is hereby granted a <br /> minimum penalty authority of one thousand dollars ($1,000.00) in <br /> accordance with 40 CFR 403.8(f) (1) (vi) (A). The Control Authority <br /> may impose additional penalties as described in Section 30-101 of <br /> the San Marcos Code of Ordinancces. <br /> (b) Any person violating any of the provisions of this <br /> Ordinance shall be liable to the city for any expense, loss or <br /> damage incurred by the city by reason of such violation.
