<br /> 79 <br /> RESOLUTION 1991- 160 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br /> CONDITIONS OF AN AGREEfv1ENT BETWEEN THE CITY <br /> AND KPMG PEAT MARWICK FOR A COMPLIANCE AUDIT <br /> OF ENVIRONMENTAL PROJECTION SYSTEMS, INC. ~ <br /> AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br /> AGREEMENT ON BEHALF OF THE CITY~ AND DECLARING <br /> AN EFFECTIVE DATE. <br /> ~qHEREAS, the City is authorized and required to perform <br />an audit of Environmental Projection Systems, Inc. ("EPS") <br />for compliance with EPS' obligation in its Economic <br />Development Agreement with the City dated April 3Ø, 1989, as <br />amended~ <br /> WHEREAS, the City desires to engage the services of its <br />external auditor, KPMG Peat Marwick, to perform this <br />compliance audit~ now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> PART 1. That the terms and conditions of the agreement <br />attached to this Resolution between the City and KPMG Peat <br />Marwick for the performance of a compliance audit of EPS are <br />hereby approved. <br /> PART 2. That the City Manager, Larry D. Gilley is <br />hereby authorized to execute this Agreement on behalf of the <br />City. <br /> PART 3.
