<br /> <br /> <br /> <br />139 <br /> <br />ORDINANCE 1988-20 <br /> <br />AN ORDINANCE OF THR CITY COUNCIL OF THR CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY <br />ZONING 0.935 ACRE OF LAND OUT OF THE J.M. VERAMENDI <br />LEAGUE NO. ONE, CITY OF SAN MARCOS, BEING A PORTION OF <br />FARM LOT #5, AND BEING ALSO A PORTION OF THAT TRACT OF <br />LAND CONVEYED TO BARTEE JOHNSON, ET AL, STEWARDS OF THE <br />METHODIST AFRICAN CHURCH, BY WILLIAM BARNETT, ET AL BY <br />DEED DATED APRIL 7, 1875, RECORDED IN VOLUME I, PAGE 517, <br />HAYS COUNTY DEED RECORDS LOCATED AT 224 S. FREDERICKSBURG <br />FROM "M" (SINGLE-FAMI LY, DUPLEX AND NEIGHBORHOOD BUSINESS <br />DISTRICT) TO "c" (COMMERCIAL DISTRICT); AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, on November 3,1987 the Zoning Commission of the City of <br />San Marcos held a public hearing regarding a request to change the <br />zoning from "M II (Single-Family, Duplex and Neighborhood <br />Business District) to "C" (Commercial District) of 0.935 acre of land <br />out of the J.M. Veramendi League No. One, to the City of San Marcos, <br />Hays County, Texas; and, <br /> <br />WHEREAS, <br />Commission <br />voted to <br />request be <br />and, <br /> <br />subsequent to said public hearing on said date, said <br />did, on November 3, 1987, consider said request and <br />approve the same and has recommende~ that such <br />approved by the City Council of said City; <br /> <br />of <br /> <br />WHEREAS, said City Council held a public hearing on the <br />February, 1988, regarding such request; and, <br /> <br />22 <br /> <br />day <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, said City Council hereby finds and determines that the <br />adoption of the following ordinance ~s in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />SECTION 1. That the following described tract of real property <br />located in San Marcos, Hays County, Texas, which is presently <br />zoned "M II (Single-family, Duplex and Neighborhood Business District <br />be rezoned "C" (Commercial District): <br /> <br />Consisting of 0.935 acre of land out of the J.M. Veramendi <br />League No. One, City of San Marcos, being a portion of Farm Lot <br />#5, and being also a portion of that tract of land conveyed to <br />Bartee Johnson, et al, Stewards of the Methodist African Church, <br />by William Barnett, et al, by deed dated April 7,1875, recorded <br />in Vol. I, Page 517, Hays County Deed Records, and which 0.935 <br />acre of land, according to a survey made on the ground in April, <br />1963, by James R. Hall, County Surveyor and Registered Public <br />Surveyor #608, is described by metes and bounds as follows: <br /> <br />BEGINNING at an iron stake set at the intersection of the West <br />line of Fredericksburg Street with the Northwest line of Valley <br />Street as recognized and used upon the ground for the Southeast <br />corner of the tract herein described; <br /> <br />THENCE leaving the West line of Fredericksburg Street with the <br />Northwest line of Valley Street as recognized and used upon the <br />ground S. 46 degrees 08 W. 54.6 fee to an iron stake set in the <br />approximate centerline of a branch for the most Southerly corner <br />of the tract herein described; <br /> <br />THENCE leaving the Northwest line of Valley Street with the <br />approximate centerline of said branch N. 55 degrees 07 W. 81.3 <br />feet to iron stake set at angle point; <br /> <br />THENCE continuing with approxiamte centerline of said branch N. <br />34 degrees 29 W. 120.6 feet to iron stake set at angle point; <br /> <br />THENCE continuing with approximate centerline of said branch N. <br />67 degrees 26' W. 155.50 feet to iron stake set on the Southeast <br />line of Center Street as recognized and used upon the ground for <br />the West corner of the tract herein described; <br />
