ORDINANCE 2012 -53 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, CANVASSING RETURNS AND DECLARING <br />RESULTS OF THE ELECTION HELD ON NOVEMBER 6, 2012 FOR <br />THE PURPOSE OF ELECTING A MAYOR, CITY COUNCIL <br />MEMBERS FOR CITY COUNCIL PLACES 5 AND 6, AND <br />PRESENTING THREE NON - BINDING PROPOSITIONS <br />REGARDING THE ACQUISITION OF 70 ACRES OF LAND IN THE <br />CAPE'S CAMP AREA TO THE VOTERS; AND DECLARING AN <br />EMERGENCY. <br />RECITALS: <br />1. On November 6, 2012 an election was held to elect candidates for the positions of <br />Mayor, City Council Member for Place 5, and City Council Member for Place 6 and to submit <br />three non - binding propositions regarding the acquisition of 70 acres of land in the Cape's Camp <br />area for parks and recreation purposes to the voters. <br />2. The results of the election have been certified and returned by the proper judges and <br />clerks. <br />3. On November 19, 2012 the City Council of the City of San Marcos, Texas <br />convened to consider the returns of the election held on November 6, 2012. <br />4. It appears to the Council, and the Council finds, that the election was in all respects <br />lawfully held. <br />5. It appears to the Council, and Council finds, that the tabulation of the results of the <br />election is correct. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The election held on November 6, 2012 was duly called, notice of the <br />election was given in accordance with law, and the election was held in accordance with law. <br />
