<br /> <br /> <br />0 <br /> <br /> <br />~, <br /> <br />">- <br />G <br />"?- <br /> <br />IT' <br /> <br /> <br />L:> <br />LLJ <br />0 <br /> <br />44 <br /> <br />ORDINANCE 1987-4 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING CHAPTER 35 <br />COMPREHENSIVE DEVELOPMENT CODE OF THE SAN <br />MARCOS CODE OF ORDINANCES BY THE ADDITION OF <br />ARTICLE II, RESIDENTIAL SUBDIVISION <br />COMPATIBILITY, AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. <br />amended by the <br />follows: <br /> <br />That the San Marcos Code of Ordinances is <br />addition of Chapter 35, Article II to read as <br /> <br />Article II. <br /> <br />Residential Subdivision Compatibility <br /> <br />SECTION 100. PURPOSE. These regulations are intended <br />to supplement the requirements of the General Zoning <br />Ordinance and the Subdivision Regulations, and to <br />implement the applicable policies of the San Marcos <br />Master Plan with regard to harmonious transition between <br />developments of differing densities, and to protect the <br />character and value of existing single-family <br />residential properties. <br /> <br />SECTION 200. <br /> <br />APPLICABILITY. <br /> <br />201. The requirements of this article shall apply to any <br />proposed subdivision of land consisting of at least <br />six lots or a total of one acre, which is zoned <br />"R-l" Single-Family Dwelling District, and which <br />abuts any existing, platted single-family <br />residential development, whether the existing <br />subdivision is inside or outside the City limits, <br />such that either of the following conditions exist <br />with respect to the lots which abut one another or <br />are separated only by a street or alley along the <br />common boundary betweeen the two subdivisions: <br /> <br />201.01 <br /> <br />the average size of lots <br />the common boundary <br />subdivision is less than <br />of lots abutting or <br />boundary in the existing <br /> <br />abutting or nearest <br />in the proposed <br />2/3 the average size <br />nearest the common <br />subdivision; or, <br /> <br />201.02 <br /> <br />the average width of lots abutting or nearest <br />the common boundary in the proposed <br />subdivision is less than 3/4 the average width <br />of lots abutting or nearest the common <br />boundary in the existing subdivision. <br /> <br />202. The requirements of this Article shall not apply if <br />all the proposed lots abutting the existing <br />subdivision are at least 11,000 square feet in size <br />and are at least 75 feet wide at the front building <br />setback line. <br /> <br />203. It is the responsibility of the subdivider to <br />determine whether this Article is applicable to the <br />proposed subdivision. <br /> <br />SECTION 300. SITE PLAN. A site plan drawn at a scale <br />not smaller than 100 feet to one inch, and containing <br />the following information, shall be submitted by the <br />subdivider: <br /> <br />300.01 <br /> <br />the proposed name of the new subdivision; <br /> <br />300.02 <br /> <br />the name, address, and telephone number of the <br />subdivider and owner of record; <br />
