.""", 50 ,,'\ ORDINANCE 1987-10 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ESTABLISHING THE GENERAL AND SPECIFIC AUTHORITY OF THE SAN MARCOS ELECTRIC UTILITY BOARD AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, Texas, sed, approved and adopted on the 22nd day of September, 1986, an or inance establishing interim rules and regulations for the operation of the electric distribution system, an interim line extension policy and providing for an electric utility board; and, WHEREAS, the San Marcos Electric appointed and is now functioning; and, Utility Board has been duly 1"'- ço f'l'\ or-'- WHEREAS, the City Council now desires to provide for said board ral and specific authority with respect to the San Marcos Electric ribution System; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, SECTION 1. That the following Chapter 9 1/2 shall be added to the Code of Ordinances of the City of San Marcos: CHAPTER 9 1/2 ELECTRIC UTILITY BOARD Sec. 9 1/2-1. San Marcos Electric Utility Interim Rules And Regulations And Interim Line Extension Policy. (a) The San Marcos Electric Utility Interim Rules And Regulations are hereby adopted as The San Marcos Electric Utility Rules And Regulations and are subject to amendment as provided below in Sec. 9 1/2-2. (b) The San Marcos Electric Utility Interim Line Extension Policy is hereby adopted as the San Marcos Electric Utility Line Extension Policy and is subject to amendment as provided below in Section 9 1/2-3. Sec. 9 1/2-2. San Marcos Electric Utility Rules And Regulations. The San Marcos Electric Utility Board is hereby authorized and directed to promulgate, revise, amend and supplement the City of San Marcos Electric Utility Rules and Regulations for electric service subject to the following requirements. (a) The San Marcos Electric Utility Board may propose changes to the rules and regulations only at a public meeting which is noticed as required by the Texas Open Meetings Act. (b) Proposed rules and regulations must be published twice newspaper or newspapers of general circulation in the and notice of a public hearing must be given with publications not more than twenty two (22) days nor than eight (8) days before the public hearing is held. in a City said less (c) Adoption of proposed rules and regulations by the San Marcos Electric Utility Board may occur after a public hearing has been closed and not more than thirty (30) days thereafter or the Board must schedule, provide public notice for and conduct a separate public hearing before the proposed rules and regulations may be adopted. (d) Any proposed rule or regulation that is adopted by the San Marcos Electric Utility Board must be published at least once in a newspaper of general circulation in the City. (e) No rule or regulation adopted by the San Marcos Electric Utility Board shall take effect sooner than thirty (30) days from the date of its first publication in a newspaper of general circulation in the City of San Marcos.
