<br /> <br />.""", <br /> <br /> <br />50 <br /> <br />,,'\ <br /> <br />ORDINANCE 1987-10 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ESTABLISHING THE GENERAL AND SPECIFIC <br />AUTHORITY OF THE SAN MARCOS ELECTRIC UTILITY BOARD AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />sed, approved and adopted on the 22nd day of September, 1986, an <br />or inance establishing interim rules and regulations for the operation <br />of the electric distribution system, an interim line extension policy <br />and providing for an electric utility board; and, <br /> <br />WHEREAS, the San Marcos Electric <br />appointed and is now functioning; and, <br /> <br />Utility <br /> <br />Board <br /> <br />has <br /> <br />been <br /> <br />duly <br /> <br /> <br />1"'- <br />ço <br />f'l'\ <br />or-'- <br /> <br /> <br />WHEREAS, the City Council now desires to provide for said board <br />ral and specific authority with respect to the San Marcos Electric <br />ribution System; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> <br />SECTION 1. That the following Chapter 9 1/2 shall be added to the <br />Code of Ordinances of the City of San Marcos: <br /> <br />CHAPTER 9 1/2 <br />ELECTRIC UTILITY BOARD <br /> <br />Sec. 9 1/2-1. <br /> <br />San Marcos Electric Utility Interim Rules And <br />Regulations And Interim Line Extension Policy. <br /> <br />(a) The San Marcos Electric Utility Interim Rules And <br />Regulations are hereby adopted as The San Marcos Electric <br />Utility Rules And Regulations and are subject to amendment <br />as provided below in Sec. 9 1/2-2. <br /> <br />(b) The San Marcos Electric Utility Interim Line Extension <br />Policy is hereby adopted as the San Marcos Electric <br />Utility Line Extension Policy and is subject to amendment <br />as provided below in Section 9 1/2-3. <br /> <br />Sec. 9 1/2-2. <br /> <br />San Marcos Electric Utility Rules And Regulations. <br /> <br />The San Marcos Electric Utility Board is hereby authorized and <br />directed to promulgate, revise, amend and supplement the City <br />of San Marcos Electric Utility Rules and Regulations for <br />electric service subject to the following requirements. <br /> <br />(a) The San Marcos Electric Utility Board may propose changes <br />to the rules and regulations only at a public meeting which <br />is noticed as required by the Texas Open Meetings Act. <br /> <br />(b) Proposed rules and regulations must be published twice <br />newspaper or newspapers of general circulation in the <br />and notice of a public hearing must be given with <br />publications not more than twenty two (22) days nor <br />than eight (8) days before the public hearing is held. <br /> <br />in a <br />City <br />said <br />less <br /> <br />(c) Adoption of proposed rules and regulations by the San <br />Marcos Electric Utility Board may occur after a public <br />hearing has been closed and not more than thirty (30) days <br />thereafter or the Board must schedule, provide public <br />notice for and conduct a separate public hearing before the <br />proposed rules and regulations may be adopted. <br /> <br />(d) Any proposed rule or regulation that is adopted by the San <br />Marcos Electric Utility Board must be published at least <br />once in a newspaper of general circulation in the City. <br /> <br />(e) No rule or regulation adopted by the San Marcos Electric <br />Utility Board shall take effect sooner than thirty (30) <br />days from the date of its first publication in a newspaper <br />of general circulation in the City of San Marcos. <br />
