On July 27, 2004, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the zoning from "R-1" Single-Family <br />Dwelling District (Low Density) to "C" Commercial District with a "PDD" Planned <br />Development District overlay for a 9.94 acre, more or less, tract of property located at 508 <br />Craddock Avenue, with a concurrent interim land use amendment. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on July 27, 2004, consider and vote to approve the request, and has recommended that the <br />request be approved by the City Council of the City. <br />3. The City Council adopted a new Land Development Code (the "LDC") on December <br />13, 2004, and the LDC contains new zoning district designations, and the new zoning district in <br />the LDC that is most similar to "C" Commercial District, and permits the use contemplated by <br />the applicant for this rezoning, is "CC" Community Commercial District. <br />4. The City Council held a public hearing on January 18 , 2005, regarding the <br />request. <br />5. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to <br />zoning map amendments have been met. <br />6. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS:
