<br />17 <br /> <br /> <br />iK) <br />/>-1 <br />ORDINANCE 1986-25 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, ORDERING A SPECIAL <br />ELECTION TO BE HELD WITHIN SAID CITY ON APRIL <br />19, 1986, IF NO CANDIDATE FOR CITY COUNCIL <br />MEMBER, PLACE ONE, ON THE BALLOT FOR THE <br />GENERAL CITY ELECTION TO BE HELD APRIL 5, <br />1986, RECEIVES A MAJORITY VOTE; ESTABLISHING <br />THE RATE OF COMPENSATION TO BE PAID JUDGES AND <br />CLERKS FOR SERVICES RENDERED DURING SAID <br />ELECTION; MAKING PROVISIONS FOR THE CONDUCT OF <br />SAID ELECTION AND OTHER PROVISIONS INCIDENT TO <br />THE PURPOSES OF THIS ORDINANCE; AND, DECLARING <br />AN EMERGENCY. <br /> <br /> <br /> <br />WHEREAS, by ordinance duly adopted on January 27, 1986, and <br />as amended on February 3, 1986, March 10, 1986, and , <br />the City Council of the City of San Marcos, Texas, ordered the <br />holding of special and joint general elections by said City and <br />the San Marcos Consolidated Independent School District on April <br />5, 1986, and adopted certain other provisions relating thereto; <br />and, <br /> <br />WHEREAS, there are four (4) candidates for City Council <br />Member, Place One, in the general election for said City; and, <br /> <br />WHEREAS, Section 5.05 of the Charter of said City requires <br />election by majority; and, <br /> <br />WHEREAS, it is possible that no candidate for City Council <br />Member, Place One, will receive a majority of the votes cast for <br />that place in said election; and, <br /> <br />WHEREAS, in such event a runoff election must be held on <br />April 19, 1986, pursuant to Section 5.05 of the Charter of said <br />City; and, <br /> <br />WHEREAS, Sections 2.026 and 4.003(b), V.T.C.A., Election <br />Code, require that notice of said runoff election be posted not <br />later than the 15th day before election day; and, <br /> <br />WHEREAS, pursuant to Section 5.07 of the Charter of said <br />City, the returns of the said general election will not be <br />canvassed by the City Council until April 7, 1986, which date is <br />twelve (12) days prior to the required runoff election date of <br />April 19, 1986; and, <br /> <br />WHEREAS, it is, therefore, impossible to meet the notice <br />requirements by posting found in Sections 2.026 and 4.003(b), <br />V.T.C.A., Election Code if said City Council waits until the <br />returns of said election i~L canvassed before ordering a special <br />election, to-wit: a runoff election on April 19, 1986; now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That in the event that no candidate for City <br />Council Member, Place One, on the ballot for the general election <br />to be held by said City on April 5, 1986, receives a majority of <br />the votes cast for said place in said election, then a special <br />election, to-wit: a runoff election, shall be held in said City <br />on the 19th day of April, 1986, to determine the winning candidate <br />for said place, and in such event, this ordinance shall be amended <br />on April 7, 1986, following the official canvass of the returns of <br />said general election in order that the names of the runoff <br />election candidates may be certified in writing by the Mayor and <br />City Council for placement on the runoff election ballot. <br /> <br />SECTION 2. That the election precincts for said elections <br />shall be, in all respects, the same precincts as those Hays County <br />Election Precincts which are within the limits of the City of San <br />Marcos. <br />
