20 a:~, ORDINANCE 1986-27 t..bJ Lb" AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ADOPTING A NEW CHAPTER TO BE ADDED TO THE CODE OF ORDINANCES, CITY OF SAN MARCOS, TEXAS, TO BE ENTITLED, "NOISE ORDINANCE"; PROVIDING FOR THE CONTROL OF NOISE; PROVDING A DECLARATION OF POLICY; DEFINING TERMS; SETTING STANDARDS; PROHIBITING CERTAIN SOUNDS; PROVIDING FOR MAXIMUM PERMISSIBLE SOUND LEVELS IN USE DISTRICTS; SETTING STANDARDS FOR MOTOR VEHICLE NOISE; PROVIDING PROCEDURES FOR MEASURING SOUND LEVELS; PROVIDING FOR RESPONSIBILITIES OF MUNICIPAL DEPARTMENTS; PROVIDING FOR PUBLIC AND PRIVATE PROJECT REVIEW; ASSIGNING ENFORCEMENT RESPONSIBILITIES; PROVIDING FOR PERMITS AND APPEALS; PROVIDING PENALTIES AND REMEDIES; PROVIDING SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PORTIONS OF ORDINANCES IN CONFLICT HEREWITH; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the making and creation of excessive, unnecessary noise within the limits of the City of San Marcos, Texas, is a condition which has existed for some time and the extent and volume of such noises is increasing; and, WHEREAS, the making, creation, or maintenance of excessive, unnecessary, or unusual noise is detrimental to the public health, comfort, convenience, safety, welfare, and prosperity of the residents of the City of San Marcos; and, WHEREAS, a substantial body of scientific and technological knowledge and expertise exists by which noise is recognized as sound which is excessive and unwanted and by which it may be substantially abated; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Short Title This chaper shall be known, cited, and referred to as "The San Marcos Noise Ordinance." SECTION 2. Declaration of Intent and Policy It is hereby found and declared that the making, creation or maintenance of excessive, unnecessary, or unusually loud sounds affects and is a detriment to the health, comfort, convenience, safety, welfare and prosperity of the residents of the City of San Marcos, Texas. It is further declared that the provisions and prohibitions adopted in this ordinance are for the purpose of securing and promoting public health, comfort, convenience, safety, welfare, and prosperity and the peace and quiet of the City of San Marcos, Texas, and its inhabitants. The policy of the City of San Marcos shall be to minimize the exposure of its residents to the physiological and psychological harm of excessive noise. It is the intent of the City Council to control the level of noise in a manner which promotes commerce; protects the sleep and repose of citizens; promotes the use, value and enjoyment of property and preserves the quality of the environment.
