<br /> 20 <br />a:~, ORDINANCE 1986-27 <br />t..bJ <br />Lb" <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS, ADOPTING A <br /> NEW CHAPTER TO BE ADDED TO THE CODE OF <br /> ORDINANCES, CITY OF SAN MARCOS, TEXAS, TO <br /> BE ENTITLED, "NOISE ORDINANCE"; PROVIDING <br /> FOR THE CONTROL OF NOISE; PROVDING A <br /> DECLARATION OF POLICY; DEFINING TERMS; <br /> SETTING STANDARDS; PROHIBITING CERTAIN <br /> SOUNDS; PROVIDING FOR MAXIMUM PERMISSIBLE <br /> SOUND LEVELS IN USE DISTRICTS; SETTING <br /> STANDARDS FOR MOTOR VEHICLE NOISE; <br /> PROVIDING PROCEDURES FOR MEASURING SOUND <br /> LEVELS; PROVIDING FOR RESPONSIBILITIES OF <br /> MUNICIPAL DEPARTMENTS; PROVIDING FOR <br /> PUBLIC AND PRIVATE PROJECT REVIEW; <br /> ASSIGNING ENFORCEMENT RESPONSIBILITIES; <br /> PROVIDING FOR PERMITS AND APPEALS; <br /> PROVIDING PENALTIES AND REMEDIES; <br /> PROVIDING SEVERABILITY; PROVIDING FOR <br /> REPEAL OF ALL ORDINANCES OR PORTIONS OF <br /> ORDINANCES IN CONFLICT HEREWITH; AND <br /> ESTABLISHING AN EFFECTIVE DATE. <br /> WHEREAS, the making and creation of excessive, <br /> unnecessary noise within the limits of the City of San <br /> Marcos, Texas, is a condition which has existed for some <br /> time and the extent and volume of such noises is <br /> increasing; and, <br /> WHEREAS, the making, creation, or maintenance of <br /> excessive, unnecessary, or unusual noise is detrimental <br /> to the public health, comfort, convenience, safety, <br /> welfare, and prosperity of the residents of the City of <br /> San Marcos; and, <br /> WHEREAS, a substantial body of scientific and <br /> technological knowledge and expertise exists by which <br /> noise is recognized as sound which is excessive and <br /> unwanted and by which it may be substantially abated; <br /> now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS: <br /> SECTION 1. Short Title <br /> This chaper shall be known, cited, and referred to as <br /> "The San Marcos Noise Ordinance." <br /> SECTION 2. Declaration of Intent and Policy <br /> It is hereby found and declared that the making, <br /> creation or maintenance of excessive, unnecessary, or <br /> unusually loud sounds affects and is a detriment to the <br /> health, comfort, convenience, safety, welfare and <br /> prosperity of the residents of the City of San Marcos, <br /> Texas. It is further declared that the provisions and <br /> prohibitions adopted in this ordinance are for the <br /> purpose of securing and promoting public health, <br /> comfort, convenience, safety, welfare, and prosperity <br /> and the peace and quiet of the City of San Marcos, <br /> Texas, and its inhabitants. The policy of the City of <br /> San Marcos shall be to minimize the exposure of its <br /> residents to the physiological and psychological harm of <br /> excessive noise. It is the intent of the City Council <br /> to control the level of noise in a manner which promotes <br /> commerce; protects the sleep and repose of citizens; <br /> promotes the use, value and enjoyment of property and <br /> preserves the quality of the environment. <br />
