<br />37 <br /> <br /> <br />I' <br />ORDINANCE 1986-29 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, CANVASSING <br />RETURNS AND DECLARING RESULTS OF THE <br />REGULAR AND SPECIAL ELECTIONS HELD ON <br />APRIL 5, 1986 FOR THE PURPOSE OF ELECTING <br />A MAYOR, A CITY COUNCIL MEMBER, PLACE ONE, <br />A CITY COUNCIL MEMBER, PLACE TWO, AND <br />CONSIDERING AMENDMENTS TO THE CHARTER OF <br />SAID CITY, THE REMOVAL OF PARKLAND AND <br />MUNICIPAL AIRPORT RESTRICTIONS ON THE USE <br />OF CERTAIN CITY-OWNED PROPERTY, AND THE <br />ACQUISITION BY SAID CITY OF CERTAIN LAND <br />TO BE USED AS A NATURE CONSERVANCY AND <br />DRAINAGE BASIN FOR THE PROTECTION OF THE <br />SAN MARCOS RIVER; AND, DECLARING AN <br />EMERGENCY. <br /> <br /> <br /> <br />WHEREAS, the City Council of the City of San Marcos, <br />Texas, by ordinance duly enacted on January 27, 1986, and as <br />amended on February 3, 1986 and March 10, 1986, ordered that <br />regular and special elections be held on April 5, 1986 for the <br />purpose of electing a mayor, a city council member, place one, <br />and a city council member, place two, and considering <br />amendments to the Charter of said City, the removal of <br />parkland and Municipal Airport restrictions on the use of <br />certain City-owned property, and the acquisition by said City <br />of certain land to be used as a nature conservancy and <br />drainage basin for the protection of the San Marcos River; <br />and, <br /> <br />WHEREAS, notice of said elections was duly published in <br />the San Marcos Daily Record on March 9, 1986 and March 16, <br />1986; and, <br /> <br />WHEREAS, copies of said notice were duly posted at each <br />city election precinct polling place prior to said elections, <br />and a copy of same was posted on the bulletin board at City <br />Hall on or before March 14, 1986; and, <br /> <br />WHEREAS, said elections were duly and legally held on the <br />5th day of April, 1986, in conformity with the election laws <br />of the State of Texas, and the results of said elections have <br />been certified and returned by the proper judges and clerks <br />thereof; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, <br />Texas, with the following members present: Karl W. Brown, Bill Coddington, <br />Gerald G. Farr, Errmie Craddock, Fred Guerra, Betty Jane Kissler and William <br />C. Nicola, <br />has today considered the returns of said regular and special <br />elections held on the 5th day of April, 1986; and, <br /> <br />WHEREAS, it appears to the Council, and the Council so <br />finds, that the said elections were in all respects lawfully <br />held; and, <br /> <br />WHEREAS, it appears to the Council, and the Council so <br />finds, that the tabulation of the results of said election is <br />correct; now, therefore, <br /> <br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the regular and special City elections of <br />April 5, 1986 were duly called, that notice of said elections <br />was given in accordance with law, and that said elections were <br />held in accordance with law. <br />
