73 RESOLUTION 1984-11R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING THE MAYOR OF SAID CITY TO MAKE APPLICATION TO THE FEDERAL AVIATION ADMINISTRATION FOR THE ACQUISITION BY SAID CITY OF APPROXIMATELY 21 ACRES OUT OF THE WILLIAM PETTUS SURVEY IN CALDWELL COUNTY, TEXAS AND LYING ADJACENT TO THE SOUTH BOUNDARY OF THE SAN MARCOS MUNICIPAL AIRPORT FOR AIRPORT DEVELOPMENT AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, Texas, desires to acquire property for the purpose of further airport development at San Marcos Municipal Airport; and, WHEREAS, the said City Council find that there is a need to utilize more of the said Airport's ramp due to the large increase in the number of planes that are based at the said Airport; and, WHEREAS, the City of San Marcos, Texas, is experiencing rapid increase in demand for facilities at San Marcos Municipal Airport due to its newly acquired role as a reliever to Robert Mueller Municipal Airport in Austin, Texas; and, WHEREAS, the best and highest use of the land to be conveyed is much more suitable as an airport facility; and, WHEREAS, this real property is vital to San Marcos Municipal Airport growth, and it would cost many thousands of dollars to construct these Airport facilities elsewhere; and, WHEREAS, the City of San Marcos, Texas, has legal authority to accept conveyance of such real property subject to the covenants and reverter clause contained in § 154.7 (b), Part 154, Federal Aviaition Regulations; and, WHEREAS, the City Council of the City of San Marcos, Texas, finds that it would be in the best interest of said City for said real property to be conveyed to said City; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the Mayor of the City of San Marcos, Texas, be and she is hereby, authorized to execute, on behalf of said City an application to the Federal Aviation Administration, a copy of which is attached hereto and incorporated herein for all intents and purposes, for the acquisition by said City of approximately 21 acres out of the William Pettus Survey in Caldwell County, Texas, and lying adjacent to the south boundary of the San Marcos Municipal Airport. PART 2. That the Mayor of the City of San Marcos, Texa s, be and she is hereby, authorized to act as the official representative of said City in connection with said application and is hereby authorized and directed to provide such additional information as may be required in connection with said application.
