<br /> ¡::ENTITLED "CODE OF ETHICS" OF CHAPTER 2, EN-
<br /> .'Ì'ITLED "ADMINISTRATION" OF THE CODE OF OR-
<br /> DINANCES, CITY OF SAN MARCOS, TEXAS, TO
<br /> ESTABLISH THAT FINANCIAL DISCLOSURE STATEMENTS
<br /> ~RE OPEN TO THE PUBLIC; TO REQUIRE THAT CANDI-
<br /> ~ATES FILE A SWORN STATEMENT WITH THE CITY
<br /> ~ECRETARY; TO DEFINE CANDIDATE, TO ELIMINATE
<br /> ~~N OBSOLETE SUBSECTION AND DECLARING AN EFFEC-
<br /> TIVE DATE.
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS,
<br /> TEXAS:
<br /> SECTION 1. That Section 2-81 of the Code of Ordinances, City
<br /> of San Marcos, Texas, is hereby amended to read as follows:
<br /> Sec. 2-&1. Definitions.
<br /> For the purposes of this division, the following
<br /> words shall have these meanings:
<br /> Candidate: Every person who declares for or
<br /> files for any office of the City of San Marcos to
<br /> be filled by election.
<br /> Business entity: Any corporation, partnership,
<br /> sole proprietorship, firm, enterprise, franchise,
<br /> association, organization, self-employed individual,
<br /> holding company, joint stock company, receivership,
<br /> trust, or any legal entity organized for profit.
<br /> City official: The mayor, every member of the
<br /> city council, the city manager, the city attorney,
<br /> the city secretary, and judges of the municipal
<br /> court. If the job title of city manager, city
<br /> attorney, city secretary, and judges of the municipal
<br /> court is changed, the term "city official" shall
<br /> include the persons charged with the duties of the
<br /> listed positions.
<br /> Compensation: Any economic benefit received in
<br /> return for labor, services, property or investment.
<br /> Economic benefit: Any money, real or personal
<br /> property, purchase, sale, lease, contract, option,
<br /> credit, loan, discount, service, or other tangible
<br /> or intangible thing of value, whether similar or
<br /> dissimilar to those enumerated.
<br /> False: A knowing or intentional misrepresentation or
<br /> concealment of any item rèqúìred.. to be (.'lìsclosed by
<br /> this division.
<br /> Family member: The spouse and any dependent children
<br /> of any official or candidate.
<br /> Gift: A favor, hospitality or economic benefit
<br /> other than compensation but which does not include
<br /> campaign contributions reported as required by state
<br /> law.
<br /> Identification: For a natural person, the person's
<br /> name, street address, city and state; for any entity
<br /> other than a natural person, the name, address, city
<br /> and state of the entity's principal location or place
<br /> of business, the type or nature of the entity, the date
<br /> on which it came into existence, the state of incorporation,
<br /> if any, the names of the partners or trustees, if any.
