62 ORDINANCE 1983-16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, GRANTING TO TRANSPORTATION ENTERPRISES, INCORPORATED, A FRANCHISE FOR ~IY:E (5) YEARS TO OPERATE AND ~ßINTAIN A MOTOR BUS SYSTEM FOR THE TRANSPORTATION OF PERSONS AND PROPERTY UPON THE PUBLIC STREETS AND HIGHWAYS OF THE CITY OF SAN MARCOS, TEXAS, PURSUANT TO THE PROVISIONS OF THE CONSTITUTION AND LAWS OF THE STATE OF TEXAS, THE CHARTER OF THE CITY OF SAN MARCOS, AND THE CODES AND ORDINANCES OF THE CITY OF SAN MARCOS; SETTING TERMS AND CONDITIONS FOR THE OPERATION OF SAID TRANSPORTATION ENTERPRISE AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That a franchise is hereby granted to Transportation Enterprises, Incorporated, a Texas corporation, pursuant to Article XI of the Charter of the City of San Marcos, Texas, as follows: A. Definitions: As used in this Ordinance, the following words and phrases shall have the meaning ascribed to them in this subsection: (1) "City" shall mean the City of San Marcos, Texas a municipal corporation of the State of Texas, located in Hays CountYr the words "in the City" or any similar reference to the territorial limits of the City of San Marcos, Texas, shall mean the area within the corporate limits of the City of San Marcos as they exist or as they may here- after be lawfully modified or extended and such areas adjacent thereto which may be lawfully served by Transportation Enterprises, Incorporated. (2) "Company" as used herein, unless the context clearly indicates otherwise, shall mean Transportation Enterprises, Incorporated, or its legally approved successors and assigns. (3) "Motor" shall mean all vehicles used for the transportation of persons or property which are propelled by power generated within themselves. (4) "Shuttle Bus Service" shall mean the operation of transporting students, faculty, staff, agents and employees of Southwest Texas State University pursuant to a contract with Southwest Texas State University and citizens of the City of San Marcos who elect to use this service. B. Nature and Extent of Grant: For and in consideration of Company equipping, maintaining and operating a shuttle bus service in the City of San Marcos, Texas, over certain described routes and between identified points as set forth on a map to be kept on file in the Office of the City Secretary of said City, City grants to Company, its successors and assigns the right and authority to operate and maintain motor buses for the transportation of persons and property upon the public streets and highways of the City of San Marcos, Texas, and such adjacent areas which may be lawfully served, for a term of five (5) years.
