<br /> 62 <br /> ORDINANCE 1983-16 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, GRANTING TO TRANSPORTATION <br /> ENTERPRISES, INCORPORATED, A FRANCHISE FOR <br /> ~IY:E (5) YEARS TO OPERATE AND ~ßINTAIN A MOTOR <br /> BUS SYSTEM FOR THE TRANSPORTATION OF PERSONS AND <br /> PROPERTY UPON THE PUBLIC STREETS AND HIGHWAYS OF <br /> THE CITY OF SAN MARCOS, TEXAS, PURSUANT TO THE <br /> PROVISIONS OF THE CONSTITUTION AND LAWS OF THE <br /> STATE OF TEXAS, THE CHARTER OF THE CITY OF SAN <br /> MARCOS, AND THE CODES AND ORDINANCES OF THE CITY <br /> OF SAN MARCOS; SETTING TERMS AND CONDITIONS FOR <br /> THE OPERATION OF SAID TRANSPORTATION ENTERPRISE <br /> AND DECLARING AN EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That a franchise is hereby granted to Transportation <br /> Enterprises, Incorporated, a Texas corporation, pursuant to Article <br /> XI of the Charter of the City of San Marcos, Texas, as follows: <br /> A. Definitions: As used in this Ordinance, the <br /> following words and phrases shall have the <br /> meaning ascribed to them in this subsection: <br /> (1) "City" shall mean the City of San Marcos, <br /> Texas a municipal corporation of the State <br /> of Texas, located in Hays CountYr the words <br /> "in the City" or any similar reference to <br /> the territorial limits of the City of San <br /> Marcos, Texas, shall mean the area within <br /> the corporate limits of the City of San <br /> Marcos as they exist or as they may here- <br /> after be lawfully modified or extended and <br /> such areas adjacent thereto which may be <br /> lawfully served by Transportation Enterprises, <br /> Incorporated. <br /> (2) "Company" as used herein, unless the context <br /> clearly indicates otherwise, shall mean <br /> Transportation Enterprises, Incorporated, or its <br /> legally approved successors and assigns. <br /> (3) "Motor" shall mean all vehicles used for <br /> the transportation of persons or property <br /> which are propelled by power generated within <br /> themselves. <br /> (4) "Shuttle Bus Service" shall mean the operation <br /> of transporting students, faculty, staff, agents <br /> and employees of Southwest Texas State University <br /> pursuant to a contract with Southwest Texas <br /> State University and citizens of the City of San <br /> Marcos who elect to use this service. <br /> B. Nature and Extent of Grant: For and in consideration <br /> of Company equipping, maintaining and operating a <br /> shuttle bus service in the City of San Marcos, Texas, <br /> over certain described routes and between identified <br /> points as set forth on a map to be kept on file in <br /> the Office of the City Secretary of said City, City <br /> grants to Company, its successors and assigns the right <br /> and authority to operate and maintain motor buses for <br /> the transportation of persons and property upon the <br /> public streets and highways of the City of San Marcos, <br /> Texas, and such adjacent areas which may be lawfully <br /> served, for a term of five (5) years. <br />
