<br />102 <br /> <br />ORDINANCE NO. 1980-13 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXA~ DECLARING THE POLICY OF <br />SAID CITY PERTAINING TO ETHICAL CONDUCT OF <br />CITY OFFICIALS AND EMPLOYEES~ DEFINING TERMS~ <br />ESTABLISHING STANDARDS OF CONDUCT FOR CITY <br />OFFICERS AND EMPLOYEES~ SETTING REQUIREMENTS <br />FOR THE DISCLOSURE OF INTEREST IN DECISIONS <br />PENDING BEFORE SAID OFFICERS AND EMPLOYEES~ <br />DESIGNATING PERSON TO WHOM DISCLOSURE SHALL <br />BE MADE~ REQUIRING A FINANCIAL DISCLOSURE <br />STATEMENT FROM CERTAIN CITY OFFICIALS~ DESIG- <br />NATING INFORMATION TO BE REPORTED ON SAID <br />STATEMENT~ SETTING PROCEDURES FOR RETENTION <br />AND INSPECTION OF ST~TEMENTS~ DESIGNATING <br />PERSON TO PROMULGATE AND PROVIDE FORMS FOR <br />STATEMENTS~ ESTABLISHING AN ETHICS REVIEW <br />COMMISSION; ESTABLISHING DUTIES OF SAID <br />COMMISSION~ SETTING PENALTIES~ PROVIDING FOR <br />SEVERABILITY AND ESTABLISHING AN EFFECTIVE <br />DATE. <br /> <br />ARTICLE I. <br />CODE OF ETHICS ADOPTED <br /> <br />SECTION 1. Declaration of Policy. <br /> <br />I <br /> <br />It is the policy of the City of San Marcos, as stated in <br />Section 12.02 (b) of the San Marcos City Charter, that all city <br />officials and employees shall act and conduct themselves both <br />inside and outside the city's service so as to give no occasion <br />for distrust of their integrity, impartiality or of their devo- <br />tion to the best interest of the City of San Marcos and the <br />public trust which it holds. <br />It is furthermore the policy of the City of San Marcos that <br />no officer or employee of the city shall have a financial interest, <br />direct or indirect, in any contract with the city, nor shall be <br />financially interested, directly or indirectly, in the sale to the <br />city of any land, materials, supplies or services. <br />To this end and to expressly assure its accomplishment, the <br />city council hereby establishes a code of ethics for the City <br />of San Marcos to serve not only as a guide for official conduct <br />of the city's public servants, but also as a basis for discipline <br />for those who violate its terms. <br /> <br />SECTION 2. Definitions. <br /> <br />For the purposes of this article the following words shall <br />have these meanings: <br /> <br />I <br /> <br />A. Officer: The mayor or any member of the city council <br />and any appointive member of a board, commission or <br />committee set up by ordinance, charter or state law <br />on a permanent basis. <br /> <br />B. Employee: Any person employed by the city whether <br />under civil service regulations or not, including <br />those individuals on a part-time basis, but such term <br />shall not be extended to apply to any independent <br />contractor. <br /> <br />C. Immediate Family: Any spouse and children, brothers and <br />sisters and/or parents of the officer or employee. <br />
