ORDINANCE NO. 2009- 12 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE <br />LAND USE MAP FROM "GC" GENERAL COMMERCIAL, "CC" <br />COMMUNITY COMMERCIAL, AND "OS" OPEN SPACE, TO "HDR" HIGH <br />DENSITY RESIDENTIAL FOR A 22.504 ACRE, MORE OR LESS PIECE OF <br />LAND; AND AMENDING THE OFFICIAL ZONING MAP OF THE CITY <br />CHANGING THE BASE ZONING FROM "GC" GENERAL COMMERCIAL <br />DISTRICT TO "MF-18" MULTI-FAMILY DISTRICT FOR A 12.743 AND <br />9.761 ACRE, MORE OR LESS, TRACT OF LAND OUT OF THE JM <br />VERAMENDI SURVEY NO. 1, ABSTRACT NO. 17; AND APPROVING A <br />LAND USE PLAN AND DEVELOPMENT STANDARDS FOR THE <br />PURGATORY CREEK PDD; INCLUDING PROCEDURAL PROVISIONS; <br />AND PROVIDING FOR PENALTIES. <br />PPrTTAT q• <br />1. On February 10, 2009, the City Planning and Zoning Commission of the City of San <br />Marcos held public hearings regarding a request to change the Future Land Use Map of the San <br />Marcos Horizons City Master Plan from "GC" General Commercial, "CC" Community <br />Commercial, and "OS" Open Space to "HDR" High Density Residential for a 22.504 acre, more <br />• or less, tract of land out of the J.M. Veramendi Survey No. 1, Abstract 17, located at the corner <br />of Hunter Road and Wonder World Drive. <br />2. On February 10, 2009, concurrently with the consideration of the land use <br />amendments, the Planning and Zoning Commission of the City of San Marcos held a public <br />hearing regarding a request to establish the zoning for the 22.504 acre, more or less, piece of land <br />described above in paragraph 1, as "PDD" Planned Development District, with base zoning of <br />"MF-18" Multi Family District to be known as the Purgatory Creek Planned Development <br />District. <br />3. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on February 10, 2009, consider and vote to approve the request, and has recommended that <br />the request be approved by the City Council of the City of San Marcos. <br />4. The City Council held a public hearing on February 17, 2009, regarding the request. <br />5. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />6. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />C? <br />J
