88 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, FEBRUARY 28, 1994 PRESENT: Mayor Kathy M. Morris Mayor Pro-Tern Bill Plummer Council Members Billy G. Ron Patterson Director of Public Works George Boeker Director of Health Terry Ewald Fire Chief Dan O'Leary Also Present: Bill Haney, Joe castillo, Jane Hughson, Richard Medina, Nina Pryatel, Collette Duran, Bob Martenis, Rose Brooks, Dorothy crittendon, Baltimar Selvera, Willie Higgs, Melissa Millecam, Mary Cauble, Roxanne McKimmey, Kelly Franks, Chris Perez, Ruben Garza, Ollie Giles, Melvia Randle and others. Mayor Morris called the meeting to order at 7:30 p.m. Mayor Morris introduced the ten-minute comment period with the city Council. (1) Baltimar Selvera advised the Council he has a 10" water main through his property, and the City wants him to provide an easement. It is his opinion the City should move this either to the side or in front of his property. Mr. GIlley is of the opinion he should pay for the move. Mr. Taylor advised the city has acquired the easement through ascription. Staff is to work this matter out and bring information to the next meeting. (2) Willie Higgs advised the Council of a sewer backup which caused him to have an inconsistent sampling. (3) Bill Haney stated regarding the sewer surcharge, residents are contributing contaminants. He stated those who have conserved are receiving higher rates. He does not feel we have yet established equality. (4) Kenneth Manning stated he does not know why he is included in the surcharge. He stated nothing goes through his lines. He is concerned with the method of sampling and how it is taken. He stated all are not included on the list, and for equality should be. (5) Paul Terry expressed concern why we need to have the surcharge ordinance on emergency, and was advised so testing can begin. He stated the SWT dorms should be included in the surcharge as residential customers. (6) Mr. and Mrs. Lorenzo Martinez stated all tenants in his building are connected to the same water line. Mayor Morris introduced for consideration approval of an appointment to the Convention and Visitors Bureau. Mr. Moore moved to appoint Ronald K. Hart to serve in Bill Plummer, Mayor Pro-Tem's stead, and Mr. Guerra seconded the motion, which passed unanimously. Mayor Morris introduced for consideration approval of one appointment of a Master Electrician to the San Marcos Electrical Board. No names were presented for consideration, and this matter will be rescheduled. Mayor Morris introduced for consideration approval of one appointment to the Central Texas Higher Education Authority. Mr. Guerra moved to appoint Virginia Mendez and Mr. Mooney seconded the motion, which passed unanimously.
