ORDINANCE NO.2018-04 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING VARIOUS SECTIONS OF THE SAN MARCOS CITY CODE FOR CONSISTENCY WITH, OR TO COMPLEMENT CONCURRENT ADOPTION OF THE NEW SAN MARCOS DEVELOPMENT CODE ("CODESMTX"); PROVIDING A SAVINGS CLAUSE; PROVIDING FOR THE REPEAL OF ANY CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. RECITALS: 1. City staff proposed amendments to various sections of the San Marcos City Code in conjunction with the adoption of a new San Marcos Development Code. 2. The City Council hereby finds and determines that the adoption of the following ordinance incorporating such amendments is in the interest of the public health,welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The San Marcos City Code is hereby amended as set forth below. Added text is indicated by underlining. Deleted text is indicated by strikethroughs. SECTION 2. Section 2.091 of the San Marcos City Code is hereby amended as set forth below. DIVISION 2. PLANNING AND ZONING COMMISSION Sec. 2.091. Membership; eligibility; term of office; training qualification requirements. (a) The planning and zoning commission consists of nine members, appointed by City Council. (b) To be eligible for appointment and continued service on the commission,all of the commission members except one will must have resided and o r.. -preperty in the city for a period of five years before the date of appointment, :.: .- -...;.•.. ..- .. .- '-- ::: -. city's oxtraterritorial jurisdiction. To be eligible for election and continued service on the commission as chair of the commission, a commission members must maintain residence reside in the city and own real property in the city. Effective March 1, '1015, the ETJ member position shall be eliminated and replaced with a member who resides in and owns real property in the city.
