ORDINANCE NO.2018-04 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AMENDING VARIOUS SECTIONS OF THE SAN <br /> MARCOS CITY CODE FOR CONSISTENCY WITH, OR TO <br /> COMPLEMENT CONCURRENT ADOPTION OF THE NEW SAN <br /> MARCOS DEVELOPMENT CODE ("CODESMTX"); PROVIDING A <br /> SAVINGS CLAUSE; PROVIDING FOR THE REPEAL OF ANY <br /> CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE <br /> DATE. <br /> RECITALS: <br /> 1. City staff proposed amendments to various sections of the San Marcos City Code <br /> in conjunction with the adoption of a new San Marcos Development Code. <br /> 2. The City Council hereby finds and determines that the adoption of the following <br /> ordinance incorporating such amendments is in the interest of the public health,welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The San Marcos City Code is hereby amended as set forth below. Added <br /> text is indicated by underlining. Deleted text is indicated by strikethroughs. <br /> SECTION 2. Section 2.091 of the San Marcos City Code is hereby amended as set forth <br /> below. <br /> DIVISION 2. PLANNING AND ZONING COMMISSION <br /> Sec. 2.091. Membership; eligibility; term of office; training qualification <br /> requirements. <br /> (a) The planning and zoning commission consists of nine members, <br /> appointed by City Council. <br /> (b) To be eligible for appointment and continued service on the <br /> commission,all of the commission members except one will must have resided and <br /> o r.. -preperty in the city for a period of five years before the date of <br /> appointment, :.: .- -...;.•.. ..- .. .- '-- ::: -. <br /> city's oxtraterritorial jurisdiction. To be eligible for election and continued service <br /> on the commission as chair of the commission, a commission members must <br /> maintain residence reside in the city and own real property in the city. Effective <br /> March 1, '1015, the ETJ member position shall be eliminated and replaced with a <br /> member who resides in and owns real property in the city. <br />
