ORDINANCE N0.2008 -15 <br />AN ORDINANCE OFTHE CITYCOUNCILOFTHE CITYOF <br />SAN MARCOS, TEXAS APPROVING THE ABANDONMENT <br />OF HENRY STREET FROM MARVIN STREET TO BELVIN <br />STREET; APPROVING THE CONVEYANCE OF THIS TRACT <br />TO THE SAN MARCOS AREA HABITAT FOR HUMANITY; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE A <br />DEED; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. Henry Street, between Belvin Street and Marvin Street, was dedicated tothe <br />City in 1910; however, Henry Street was never constructed and there are no utilities in the <br />right of way. <br />2. On February 26, 2008, theCityPlanning and Zoning Commission conducted <br />a public hearing on the proposed abandonment of the Henry Street, and voted <br />unanimously to recommend approval of the proposal. <br />3. The City Council conducted a public hearing on the abandonment of Henry <br />Street on March 18, 2008. <br />4. The San MarcosArea Habitatfor Humanityownsthe propertyabutting both <br />sides of Henry Street and are in the process of replating the area for utilization as home <br />sites. The San Marcos Area Habitat for Humanity has requested and consented to this <br />abandonment. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION ? . The abandonment of Henry Street, as shown on the attached map, is <br />approved. <br />SECTION 2. The Interim City Manager, Collette Jamison, is authorized to execute <br />the deed attached to this ordinance conveying Henry Street described above to the San <br />MarcosArea Habitatfor Humanity. <br />SECTION 3. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Clerk will publish notice of its adoption in a newspaper of general <br />circulation in the City. <br />PASSED AND APPROVED on first reading on March 18, 2008. <br />PASSED AND APPROVED on second reading on April 1, 2008.
